In response to comments dated November 28, 2007, we offer the following comments.
1. Level Spreader 2
a. A dry pond has been added upstream of the level spreader to reduce the overall
length of the system. A bypass riser is included to bypass larger storm events.
b. Dry pond added as noted above.
c. Bypass ditch has been added, calculations for lining are included in the submittal
information.
2. The typical level spreader detail is on sheet 17 as noted on the revised worksheet. The
previous reference to sheet 9 was incorrect.

REQUEST FOR MORE INFORMATION
Dear Mr. Blankenship:
On October 17, 2007, the Division of Water Quality (DWQ) received. your application dated October 17,
2007, to fill or otherwise impact 46 feet of perennial stream and 3,110 square feet of Zone 1 Neuse River
basin protected riparian buffers and 2,304 square feet of Zone 2 Neuse River.-basin protected riparian
buffers to construct the proposed office/business park. The DWQ has determined that your application
was incomplete and/or provided inaccurate information as discussed below. The DWQ will require
additional information in order to process your application to impact protected wetlands and/or streams on
the subject property. Therefore, unless we receive five copies of the additional information requested
below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and
will place this project on hold as incomplete until we receive this additional information. Please provide
the following information so that we may continue to review your project.
Additional Information Requested:
There aze a number of issues associated with the design of the level spreaders serving drainage
area 2:
a. The DWQ recommends revising the currently proposed design such that flow from the
drainage area is first routed to a dry detention basin and then to one level spreader. This
design would reduce the length of level spreader required to diffuse the flow and would
also eliminate the need for the scour hole and the two forebays proposed in the current
design.
b. If the applicant chooses to .retain the current proposal with two separate level spreaders,
additional details and calculations regarding the flow splitting device must be provided
for the DWQ to insure that it will operate correctly (i.e., provide the correct flows from
the one inch/hour storm to each of the two level spreaders).
c. Regazdless of the design the applicant chooses, a properly designed bypass device must
be provided. .

2. The submittal does not include enough information for the DWQ to evaluate the level spreader
serving drainage area 5. Please provide the plan details for this level spreader (they are not on
Plan Sheet 9 as stated in the Required Items Checklist).
Please provide the following items as listed on the Required Items Checklist and provide page
numbers for these items in your resubmittal so that the DWQ can reference them efficiently.
a. An assurance that the installed system will meet design specifications upon initial
operation once the project is complete.
b. The supporting calculations.
c. A copy of the deed restriction that protects the level spreader device.
Please submit this information within 30 calendar days of the date of this letter. If we do not receive this
requested information within 30 calendar days of the date of this letter, your project will be withdrawn
and you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not

In accordance with Title 15 A NCAC 2H .0500, the following DEED NOTIFICATION shall be'
recorded in the Wake County Registry prior to the conveyance of lots. Said Deed

buffer filling or draining, so the property owner should not assume that a future application for

Low Density Commercial Subdivisions
Deed Restrictions & Protective Covenances
In accordance with Title 15 NCAC 2H.1000, the Stormwater Management Regulations, deed restrictions and
protective covenants are required for Low Density Commercial Subdivisions where lots will be subdivided and
sold. The deed restrictions and protective covenants are necessary to ensure that the development maintains
a "built-upon" area consistent with the permitted maximum to maintain overall low density.

cause the following deed restrictions and covenants to be recorded prior to the sale of any lot within the project
known as
1. The following covenants are intended to ensure ongoing compliance with State Stormwater
Management Permit Number , as issued by the Division of Water Quality under
NCAC 2H.1000.
2. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to
maintain compliance with the stormwater management permit.
3. These covenants are to run with the land and be binding on all persons and parties claiming under

consent of the State of North Carolina, Division of Water Quality.

The allotted amount includes any built-upon area constructed within the lot property boundaries, and
that portion of the right-of--way between the front lot line and the edge of the pavement. Built upon area

does not include raised, open wood decking, or the water surface of swimming pools.
7. In the case of a lot within CAMA's regulated AEC, if the built-upon area for that lot, as calculated by
CAMA, is less than the amount shown in these restrictions, the most restrictive BUA will be the
maximum permitted limit for that lot.
8 Filling in or piping of any vegetative conveyances (ditches, swa/es, etc.) associated with the
development except for average driveway crossings, is strictly prohibited by any persons.
9. Each lot will maintain a 30' wide vegetated buffer between all impervious areas and surface waters.
10. All roof drains shall terminate at least 30' from the mean high water mark of surface waters.
11. Each lot, whose ownership is not retained by the permittee, shall submit a separate low density
stormwater permit application to the Division of Water Quality and receive a permit prior to construction.
Lots retained by the permittee shall be submitted as modifications to the original permit.
12. No lot shall be allowed to exceed the maximum allowable built-upon area unless the permit is modified
to high density for all of the lots in the permitted subdivision.

High Density Commercial Subdivisions
