Dear Mr. Games:

Please accept this for the Marvin Carden project (DWQ Project # 1623), in response to Kyle Games
letter of October 31, 2007.
We were not aware of the length of time and cost required for requesting a major variance for zone 1 of
the Pam Tar Buffer rules. Now that Mr. Barnes has denied Mr. Carden use of his property in zone 1,
we are modifying the request to not fill in zone 1. I made a visit to the Washington office, reviewed the
variance procedure with Mr. Kyle Barnes and believe that the variance process creates an undo
hardship on Mr. Carden with no relief for the effort. Therefore, I am including the revised plan sketch of
our request submitted with the CAMA permit. I have highlighted the areas that have been modfied as
to show no intrusion in zone 1, other than permitted 6' corridor for water access. This reflects the
issues as discussed by Mr. Games. Once the grass covers the requested site plan, it will again provide
general sheet flow of storrnwater without any concentration concerns.
Thank you for understanding that our delay in responding is not from disregard to the importance of
DWQ's request. I hope this will complete Mr. Garden's project.
