Conditions of approval were stipulated in the permit; however, Condition 7 required an addition to the Declaration of Covenants, Conditions and Restriction for The Rivers Edge Subdivision (Covenants). Particularly, the Covenants call for lot owners to keep their lots mowed and maintained, which would have conflicted with the State rules prohibiting mowing that portion of a lot designated in the Conservation Easement. In order to amend the Covenants, 75% of the lot owners of The Rivers Edge Subdivision had to agree to the addition to the Covenants. This has now been accomplished and recorded and can be found as an attachment to this Letter of Transmittal. Please consider these documents as compliance with the Condition of Approval and that the developer of The Rivers Edge Subdivision intends to proceed with the fill authorized by the 401 Water Quality Certification #06-0703.
