PROJECT SUMMARY: The applicant proposes to construct a community pier, platform and kayak launching facility. BBN Mercer, LLC and Mill Creek Holdings, LLC Page Two 9. PROJECT DESCRIPTION Southern Environmental Group, Inc., representing BBN Mercer, LLC and Mill Creek Holdings, LLC, has requested that the attached application be processed under the Express Permit Review Program. The applicant's project is located within the Mill Creek Cove Subdivision at the end of Lakeland Drive, adjacent to Mill Creek, between Bolivia and Supply, in Brunswick County. To find the property, take Highway 17 south from Wilmington and turn left onto NC-211. Continue on NC-211 towards Southport-Supply and turn right onto Sunset Harbor Road. Travel approximately 2- 3miles along Sunset Harbor Road and turn left into Mill Creek Cove Subdivision. The site will be located along the southern side of the property. In order to avoid the maze of unnamed roads within the subdivision, it may be simpler to park along the shoulder of Sunset Harbor Road and walk to the site where the pier is proposed. The site is located just off the side of Sunset Harbor Road, just before the bridge crossing Mercer Mill Creek (just south of the entrance). The pier location is roughly 100' east of Sunset Harbor Road. Residential properties border the site to the north and Mill Creek borders the site to the east and south. Sunset Harbor Road borders the property towards the west. The subject property is approximately 5.67 acres with roughly 6, l 341inear feet of shoreline along Mill Creek. Elevations at the site range from 15'-19' above Normal High Water (IvHW). High-ground vegetation on the tract consists primarily ofLong-leaf Pine, Loblolly Pine, Live Oaks, Black Gum and Holly. Under story vegetation consists of Wax Myrtle, Baccharus and Yaupon. Coastal marsh vegetation, including, Black Needle Rush, Spike Grass and Smooth Cordgrass Marsh exists along the eastern and southern shoreline. The marsh area adjacent to the site ranges in width from approximately 20' to 150'. Currently, the subdivision portion of the property is under construction, with the exception of the roadways and infrastructure, which have already been completed. No new work, other than what is being proposed within this permit application package, is located within the Area of Environmental Concern (AEC), and therefore is not being applied for under this permit application. The waters of the Mercer Mill Creek, adjacent to the project site, are classified as SC by the North Carolina Division of Water Quality. The area is designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and according to the Division of Environmental Health, Shellfish Sanitation Section, the waters of Mercer Mill Creek, in the area of the proposed project, are CLOSED to the harvesting of shellfish. PROPOSED PROJECT The applicant proposes to construct a community pier, platform and kayak launching facility. As proposed, the pier (6' x 158') would originate from high ground near the terminal end, or cul-de-sac, of Lakeland Drive. The pier would span towards the southeast, crossing a 60' section of "404" and coastal marsh, before terminating just waterward of the edge of marsh/normal high and normal low water line. A 10' x 30' platform would be located at the terminal end of the access pier, which would be located over open water. A 10' x 10' covered gazebo would be centrally located within the footprint of the platform and the remaining areas would be uncovered. The platform would give way to a small irregular shaped floating dock (6' x 4', with a 4' x 2' side to dock), located along the southern side of the platform. Water depths at the terminal end of the platform structure average approximately 3.0' below Normal Low Water (NLW). The proposed pier and platform would be used for crabbing, fishing and kayak launching, with no boat dockage. The applicant has received approval from the North Carolina Division of Water Quality, for low-density development under Low-Density Stormwater Permit SW8051004 for the subdivision portion of the project. Additionally, the applicant has obtained approval from the Division of Land Resources, under a Sedimentation and Erosion Control Plan (SECP), permit #Bruns-2006- 080. As proposed, no portion of the access pier, platform or kayak launching dock would be located beyond '/4 of the width of the water body. ANTICIPATED IMPACTS: The initial construction ofthe project would result in the disturbance ofapproximately 540 sq. ft. ofhigh ground.
