Waddell, Executive Director North Carolina Global Transpark Authority 2780 Jetport Road, Suite A Kinston, North Carolina 28504-8032 Dear Ms. Waddell: This correspondence confirms our receipt of the letter dated November 10, 2005, sent to us on your behalf by Mr. Jerry McCrain, EcoScience, regarding the final disposition of the Dover Bay and Stonyton Creek mitigation projects. This mitigation work is associated with the Department of the Army individual permit (AID 199202851) issued to the North Carolina Global Transpark Authority (NCGTPA) authorizing the construction and development of a global air transportation facility north of Kinston, between North Carolina Highways 58 and 258, in Lenoir County, North Carolina. This correspondence also confirms my telephone conversation with Mr. McCrain on December 14, 2005. Specifically, you requested guidance on whether the transfer of the Dover Bay site should be fee title simple, or through granting of a conservation easement with the NCGTPA maintaining ownership of the property. In response, given that the NCGTP is contemplating the banking of mitigation "credits" from the Dover Bay site through the development of a mitigation banking instrument (MBI), maintaining ownership of the property would facilitate the development and administration of the mitigation bank. Therefore, a conservation easement would be the best way to proceed. That said, the final decision remains up to the NCGTPA. Theā€¢NCGTP has contemplated for some time the creation of a mitigation bank utilizing the Dover Bay site. As discussed, this complicates matters but the Corps will consider any proposal you may submit. Please be aware that the conditions of your permit remain in full force and effect and must be taken into account when developing the MBI. This may also necessitate further modification of the permit.
