US 64 from I-440 (Raleigh Beltline) to existing US 64 near SR 1003, I- 440 from 0.83 mile south of US 64 to Poole Road and a portion of the East Wake Expressway from Existing US 64 to the Proposed US 64 Bypass. Wake County. State Project No 8.1402202. Federal Aid Project No. NHF-DPI-0199 (004). TIP No. R-2547. WQC Project No. 011689. The North Carolina Department of Transportation proposes to construct a new controlled-access six lane, divided highway to be known as the Knightdale Bypass. The new location of the project consists of the Bypass (R-2547) which would extend from I-440 (Raleigh Beltline) to existing US 64 near SR 1003, and a portion of the Eastern Wake Expressway (R- 2641) from existing US 64 to the proposed Bypass. The project also includes the widening of I- 440 from 0.83 miles south of US 64 to. Poole Road. On April 10, 2002 your office issued a Section 401 permit and a certification under the Neuse River Buffer Rules. The project has been let and construction has begun. The purpose of this submittal is to request a modification to the Neuse Buffer Certification to reflect a change in the design of the level spreader that had been proposed at Station 155+00. There will be no. change to the impacts to the regulated buffers. It has been determined that the ditch from station 154+60 to, 155+00-L-Rt. is obstructed by a natural ridge which prohibits the installation of a level spreader that discharged into the tributary to Mark's Creek at the upstream end of the proposed culvert (Figure 1). Therefore, the design has been modified by adding two pipes connecting directly into the proposed culvert, which will collect offsite runoff from 0.9 Ha (2.2 acres) and 1.2 Ha (2.8 acres), respectively (Figure 2). In addition to the offsite runoff, there will be 0.6 Ha (1.4 acres) onsite runoff, which will be treated in a 60 m (197 feet) long, 1.5 in (5 feet) base grass swale, as depicted in Figure 2 February 14, 2002 2 and on the corresponding modified permit sheets 8 and 9 of 24. The design of this grassed swale includes a rock check dam that will function to alleviate the offsite runoff from the 2.2 acre area from mixing with the on-site runoff and ensure that the grassed swale functions. MITIGATION Since there are no change in impacts to buffers there will be no additional mitigation required. REGULATORY APPROVALS This modification application contains revised permit application sheets 8 and 9 of 24 as well as two half size drawings, one depicting a plan view of the site and the second a drawing of the temporary rock silt check dam. We request that the Buffer Certification issued as Condition 10 of the 401 Water Quality Certification be modified to allow the revised design.
