The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until the following information is received: 1. The following sections of the application need to be completed: Section A.1. of page 1, Section D.2. of page 6, and pages 9 and 10. [15A NCAC 02H .0502(g)] 2. The application specifies Nationwide Permit (NWP) number 39, but typically residential developments are permitted under NWP number 29. In addition, the NWP number needs to be verified by the U.S. Army Corps of Engineers. [15A NCAC 02H .0502(a)(7)] 3. A complete review of the project cannot be conducted until the U.S. Army Corps of Engineers has verified all stream and wetland locations for Stonegate. Since Section B.5. of the application states that Stonegate consists of a multi - phased development, the project history needs to be researched and accounted for in the application. Phased projects can have implications for mitigation and cumulative impacts. [15A NCAC 02H .0502(g)] 5. Submit a Level Spreader Supplemental Form with all required items for each proposed level spreader. [15A NCAC 02B .0233(5)] 6. Calculations for each level spreader must be shown since a non - erosive velocity of two cubic feet per second or less must be achieved per Table 8 -1 (including the notes below it) of the BMP manual. [15A NCAC 02B.0233(5)] Pursuant to Title 15A NCAC 02H .0502(c) and Title 15A NCAC 0213 .0233 (8), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please respond in writing within 30 calendar days of receipt of this letter by sending four copies of all of the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699 -1617. Please be aware that you have no authorization under the Water Quality Certification Rules or the Neuse Riparian Buffer Rules for this activity.
