Mr. Hal Fogleman, acting as agent for Donald Caison, has submitted a request to modify CAMA Major Permit No. 18 -09,
which was issued on May 22, 2009. The permit was scheduled to expire on December 31, 2012; however, it was
extended in accordance with Session Law 2009 -406, and amended by Session Law 2010 -177, the Extension Act. The
new expiration date for State Permit No. 18 -09 is August 11, 2015.
The permittee is requesting authorization to allow for alteration of the permitted boat basin, bulkhead and docking facility.
As permitted, a 20' deep x 40' wide boat basin was to be constructed in the center portion of the lot, bordering the canal.
An 8' wide x 22' long floating dock was to be placed in the center of the basin, running perpendicular to the shoreline. In
addition, two boat lifts were to be installed, one on either side of the floating dock. Currently, the permittee is seeking to
abandon the original design and shorten the depth of the basin and place the floating dock closer to the run of the canal,
parallel with the shoreline (see attached drawing dated received by DCM on January 22, 2015). As designed, the new
bulkhead alignment would originate from the property line and would cut back into the high ground at a 45 degree angle.
The angled portions of the proposed bulkhead would measure 15' in length and would cut back toward the center of the
basin where they would connect to a straight section of wall measuring approximately 35' in length (running parallel to
the shoreline). A new 6' x 10' fixed elevated platform.would be located along the southern side of the basin (originating
from high ground and extending out over the bulkhead into open water) and this structure would provide access to a 6' x
24' floating dock (which would run parallel to the shoreline).

To summarize, the revised basin and docking system design would eliminate one of the previously permitted slips.
Additionally, the area of high ground excavation would be reduced by nearly half of that originally permitted and the total
length of the bulkhead would be reduced by more than one-third. As designed, the proposed changes would not impact
any coastal wetlands as the development area is void of wetland vegetation.
The permittee's agent has submitted a check 0#7143) in the amount of $ 100.00 for the modification.
This office has no objection to the modification request, provided all other local, State and federal regulations are adhered
to. By copy of this memo, DCM is requesting that the USACE, DWR and DCM]Fisberies Resource Specialist,
provide any comment that your agency may have on the proposed project to Jonathan Howell of DCM's Morehead
City office within 10 days of receipt of this memo.

Minor Modification
Donald Caison would like to modify the original work drawings, The new proposal
allows for a 6 x 24 floating dock that is parallel to the channel. The bulkhead is set
back from the channel 16'. The previous design was a slip that was set back 40' and
was perpendicular to the channel.
There will be a 6 x 10 fixed dock with 3 x 10 ramp to the floating dock.

with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Excavation
1) In order to protect juvenile finfish resources, no excavation shall be permitted between April I and
September 30 of any year without prior approval of the North Carolina Division of Coastal
Management and the Division of Marine Fisheries.
2) No excavation shall take place outside the area indicated on the attached workplan drawings.
3) Excavation shall not exceed -5 feet below the normal low water level. In no case shall the deptYi of
excavation exceed the depth of the connecting waters.
4) The temporary. placement of double handling of excavated materials within waters or vegetated
wetlands is not authorized.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Divisi6n approval.
All work must cease when the permit expires on
