Director Division of Water Quality February 26, 2007 DWQ# 07-0097 Guilford County CERTIFIED MAIL: 7004 2510 0002 2200 9936 RETURN RECEIPT REQUESTED Reference: Section 401 Water Quality Certification for Piedmont Centre, Section VII, Lots SA and 5B Mr. Lowell Easter SDL Johnson City, LLC 4035 Premier Drive, Suite 203 High Point, NC 27265 Dear Mr. Easter: On January 18, 2007, the North Carolina Division of Water Quality (DWQ) received your application for a 401 General Water Quality Certification to impact 115 linear feet of perennial stream in order to place a 108-inch diameter corrugated aluminum pipe and associated riprap energy dissipater pad in an unnamed tributary to the East Fork of the Deep River located in High Point, Guilford County. On February 8, 2007, Mr. Daryl Lamb of DWQ's Winston-Salem Regional Office visited this site in order to assess the proposed impacts. Based on the information provided in your application and Mr. Lamb's site assessment, additional information is required in order that we may determine your project's compliance with 15A NCAC 2H .0500. Please provide five (5) copies of the following information: 1. A review of the project site plan indicates that the proposed culvert does not serve any existing road within the commercial development currently under construction. Onsite discussions with Mr. Chris Hay of Trigron Engineering revealed that the crossing is intended to serve a future road that is part of a transportation improvement plan proposed by the City of High Point. Please be advised that the North Carolina Division of Water Quality will not approve the placement of any culvert in a stream intended for a future road crossing. The placement of a culvert in a stream for a road crossing must either serve an existing road or be placed in conjunction with the construction of a new road that has a definite terminus at both ends. Please modify your site development plan to .include a road to be built simultaneously with the construction of the culverted stream crossing or remove this culvert from the plan. Until the information requested in this letter is provided, I will request (by copy of this letter) that the U.S. Army Corps of Engineers place this project on.hold. Also, this project will be placed on hold for DWQ processing due to incomplete information (15A NCAC 2H .0507(h)). The processing of this application will begin when the requested information is received. Please be advised that if your proposed activity is subject to Section 404 of the Clean Water Act (33 U.S.C. 1344), you must also receive a Section 401 Water Quality Certification from the N. C. Division of Water Quality before you begin any work.
