The project was permitted under USACE Action ID 199500688 in January 1995 and the
project was never completed. The original fill request was for 0.60 acres of fill within lots
18, 19, 21 and 22, 0.12 acre of fill for the road crossing and 0.12 acres of fill on lot 32. It
appears that fill material was placed on Lot 32, and as part of the road crossing; however,
the fill was never placed into lots 18, 19, 21 and 22. The properties located along Hidden
Fawn Lane have been purchased by private individuals (not associated with the
developer) and they are requesting that the road crossing be completed and paved. Fill
has been placed into the wetlands as proposed in the original permit, but the culvert was
never installed to convey the flow from the upper wetlands to the run of the branch. At this
time we are trying to complete the installation of the culvert pipe to complete the original
intent of the road crossing permit. The fill impacts for lots 18, 19, 21 and 22 are not being
requested as part of this permit application.
We are proposing two options for mitigation. The first option is through deed restrictions
on lots 18, 19, 21, 22, and 32, which are currently under the ownership of the Estate of Mr.
Richard Bryant, III. The second mitigation option is through the purchase of NCEEP
Credits, if the site is accepted.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local landmarks
such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries
and development plans in relation to surrounding properties. Both the vicinity map and site plan
must include a scale and north arrow. The specific footprints of all buildings, impervious
surfaces, or other facilities must be included. If possible, the maps and plans should include the

9. Describe the existing conditions on the site and general land use in the vicinity of the project at
the time of this application: The majority of the subdivision is developed as residential and this
area is in a natural state since it has not been developed for residential dwellings. It I s
proposed to develop lots 18,19,21 and 22 as residential lots.
10. Describe the overall project in detail, including the type of equipment to be used: The road
development and culvert installation equipment will likely consist of backhoe, grader,
compacter, motor grader, excavator, rubber tired bulldozer and loader, vibrator and static
rollers, pavers, and hauling vehicles, bush hogs,
11. Explain the purpose of the proposed work: The proposed fill impacts will be limited since the
majority of the fill has been placed in the areas prior to this permit. The main area of impact
will occur in the area of the flow dissipater with the installation of rip-rap to prevent erosion
on the downstream side of the road crossing. The road crossing impact of 0.0068 acres. This

will allow the residents on either side of the crossi~ a secondary access and the postal service
to complete its delivery route. The cumulative impact for this permit is 0.0068 and the total
impact to date will be 0.1268 for the road crossing and the 0.12 fill impact on lot 32.
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this project
(including all prior phases of the same subdivision) in the past, please explain. Include the
USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.LP. project, along with
construction schedules.
An original fill impact permit was issued for the site in January of 1995 to fill a total of 0.84 acres
under USACE Action ID 19950068 as a NW26 and NW14. A copy of the permit is enclosed for
your review. The fill impact was completed it appears on lot 32 (Unable to discuss with previous
applicant) and a portion of the impact to the area of the road crossing has occurred (0.1132 acres).
No additional permits have been applied for at this time.
V. Future Project Plans
Are any future permit requests anticipated for this project? If so, describe the anticipated work,
and provide justification for the exclusion of this work from the current application.
There are no additional future impacts known at this time.
VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. The applicant must also
provide justification for these impacts in Section VII below. All proposed impacts, permanent and
temporary, must be listed herein, and must be clearly identifiable on an accompanying site plan.
All wetlands and waters, and all streams (intermittent and perennial) must be shown on a
delineation map, whether or not impacts are proposed to these systems. Wetland and stream
evaluation and delineation forms should be included as appropriate. Photographs may be included
at the applicant's discretion. If this proposed impact is strictly for wetland or stream mitigation,

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts

were minimized once the desired site plan was developed. If applicable, discuss conshuction
techniques to be followed during construction to reduce impacts.
The engineer designed the road crossing to be within the 296 sc~ foot area that has historically
been impacted to minimize additional impacts. The completion of the crossing will complete the
roadway infrastructure of the intent of the initial subdivision design.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division
of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater
wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including
size and type of proposed impact and function and relative value of the impacted aquatic resource
will be considered in determining acceptability of appropriate and practicable mitigation as
proposed. Examples of mitigation that may be appropriate and practicable include, but are not
limited to: reducing the size of the project; establishing and maintaining wetland and/or upland
vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource
functions and values by creating, restoring, enhancing, or preserving similar functions and values,
preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order for
USACE or DWQ to consider the application complete for processing. Any application lacking a
required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An
applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft
Technical Guide for Stream Work in North Carolina, available at
htt~://li2o.ei~r.state.nc.usinc~vetlands/strm~de. html.

Dear Mr. Galloway:
Please reference your application dated November 14, 1994, for
Department of the Army (DA) authorization to discharge fill material into 0.12
acres of jurisdictional wetlands to construct a road crossing. In your
application you also requested to fill two wetland areas totally 0.72 acres of
wetlands to be used for improving lots. All of the proposed fill is located
off State Road 1567 (entranced through Bellowing Doe Road), above the
headwaters of Bellowing Doe Branch in Hampstead, Pender County, North
Carolina.
For the purposes of the Corps of Engineers' Regulatory Program, Title
33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization was
provided, pursuant to Section 404 of the Clean Water Act, for discharges of
dredged or fill material into headwaters and isolated waters. Also,
authorization pursuant to Section 10 of the Rivers and Harbors Act of 1899 and
Section 404 of the Clean Water Act, was provided for fills for roads crossing
waters of the United States (including wetlands and other special aquatic
sites) provided:
a. The width of the fill is limited to the minimum necessary for the
actual crossing;
b. The fill placed in waters of the United States is limited to a
filled area of no more than one-third acre. Furthermore, no more than a total
of 200 linear feet of the fill for the roadway can occur in special aquatic
sites, including wetlands;
c. The crossing is culverted, bridged or otherwise designed to prevent
the restriction of, and to withstand, expected highflows and the movement of
aquatic organisms;
d. The crossing, including all attendant features, both temporary and
permanent, is part of a single and complete project for crossing of a water of
the United States; and
e. For fills in special aquatic sites, including wetlands, the
permittee notifies the District Engineer (DE) in accordance with the
"Notification" general condition.

GENERAL CONDITIONS
1. Navigation. No activity may cause more than a minimal adverse effect on
navigation.
2. Proper Maintenance. Any structure or fill authorized shall be properly
maintained, including maintenance to ensure public safety.
3. Erosion and Siltation Controls. Appropriate erosion and siltation
controls must be used and maintained in effective operating condition during
construction, and aZI exposed soil and other fills must be permanently
stabilized at the earliest practicable date.
4. Aquatic Life Movements. No activity may substantially disrupt the
movement of those species of aquatic life indigenous to the waterbody,
including those species which normally migrate through the area, unless the
activity's primary purpose is to impound water.
5. Equipment. Heavy equipment working in wetlands must be placed on mats or
other measures must be taken to minimize soil disturbance.
6. Regional and Case-by-case Conditions. The activity must comply with any
regional conditions which may have been added by the Division Engineer and any
case specific conditions added by the Corps.
7. Wild and Scenic Rivers. No activity may occur in a component of the
National Wild and Scenic River System; or in a river officially designated by
Congress as a "study river" for possible inclusion in the system, while the
river is in an official study status. Information on Wiid and Scenic Rivers
may be obtained from the National Park Service and the U.S. Forest Service.
8. Tribal Rights. No activity or its operation may impair reserved tribal
rights, including, but not limited to, reserved water rights and treaty
fishing,and hunting rights.
9. Water Quality Certification. In certain states, an individual state
water quality certification must be obtained or waived.
10. Coastal Zone Management. In certain states, an individual state coastal
zone management consistency concurrence must be obtained or waived.
11. Endangered Species. No activity is authorized under any NWP which is
likely to jeopardize the continued existence of a threatened or endangered
species or a species proposed for such designation, as identified under the
Federal Endangered Species Act, or Which is likely to destroy or adversely
modify the critical habitat of such species. Nan-Federal permittees shall
notify the District Engineer if any listed species or critical habitat might
be affected or is in the vicinity of the project and shall not begin work on
the activity until notified by the District Engineer that the requirements of

the Endangered Species Act have been satisfied and that the activity is
authorized. Information on the location of threatened and endangered species
can be obtained from the U.S. Fish and Wildlife Service and National Marine
Fisheries Service.
12. Historic Properties. No activity Which may affect Historic Properties
listed, or eligible for listing, in the National Register of Historic Places
is authorized, until the District Engineer has cocaplied with the provisions of
33 CFR 325, Appendix C. The prospective permittee must notify the District
Engineer if the authorized activity may affect any historic properties listed,
determined to be eligible, or which the prospective permittee has reason to
believe .may be eligible for listing on the National Register of Historic
Places, and shall not begin the activity until notified by the District
Engineer that the requirements of the National Historic Preservation Act have
been satisfied and that the activity is authorized. Information on the
location and existence of historic resources can be obtained from the State
Historic Preservation office and the National Register of Historic Places (see
33 CFR 33o.4(g)).
13. Notification.
a. Where required by the terms of the NWP, the prospective permittee must
notify the District Engineer as early as possible and shall not begin the
activity
(t) until notified by the District Engineer that the activity may
proceed under the NWP with any special conditions imposed by the District or
Division Engineer; or
(2) if notified by the District or Division Engineer that an
individual permit is required; or
(3) Unless 30 days have passed from the District Engineer's receipt
of the notification and the prospective permittee has not received notice from
the District or Division Engineer. Subsequently, the permittee's right to
proceed under the NG1P may be modified, suspended or revoked only in accordance
with the procedure set forth in 33 CFR 33o.5(d)(2).
b. The notification must be in writing and include the following
information and any required fees:
(1) Name, address and telephone number of the prospective permittee;
(2} Location of the proposed project;
(3) Brief description of the proposed pro3ect; the project's purpose;
direct and indirect adverse environmental effects the project would cause; any'

other NWP(s}, regional general permit(s) or individual permit(s) used or
intended to be used to authorize any part of the proposed project or related
activity;
(~) Where required by the terms of the NWP, a delineation of affected
special aquatic sites, including wetlands; and

NATIONWIDE CONDITIONS
a. The discharge does not cause the loss of more than l0 acres of waters
of the U.S. For the purpose of this nationwide permit, the acreage of loss of
waters of the U.S. includes the filled area plus waters of the U.S. that are
adversely affected by flooding, excavation, or drainage as a result of the
project.
b. A 30-day notification to the District Engineer (DE) is required if
the discharge would cause the loss of water of the U.S. greater than one acre.
For discharges in special aquatic sites, including wetlands, the notification
must include a delineation of affected special aquatic sites including
wetlands.
c. The discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project.
STATE CONSISTENCY CONDITIONS
a. All fill material authorized by this permit must be obtained from an
upland source.
b. Use of this nationwide permit for waste disposal facilities is not
authorized.
c. If the proposed activity is within the North Carolina Coastal Area
and the activity will result is the loss of waters of the United States
greater than 1/3 of an acre, the applicant must receive written concurrence
from the North Carolina Division of Coastal Management (NCDCM) that the
activity is consistent with the North Carolina Coastal Management Program.
d. Should all or part of a proposed activity be located within an Area
of Environmental Concern (AEC) as designated by the North Carolina Coastal
Resources Commission, a Coastal Area Management Act (CAMA) permit is required
from the North Carolina Division of Coastal Management (NCDCM). Should an
activity within or potentially affecting an AEC be proposed by a Federal
agency, a consistency dete^^~nation pursuant to 15 CFR 930 must be provided to
the NCDCM at least 90 days before the onset of the proposed activity.
GENERAL CERTIFICATION CONDITIONS
a. General Certification is denied for fills greater than one area in
SA, trout, HQW, ORW, WS-I and WS-II watersheds. General certification is
issued for all other waters for fills of not more than 10 acres and in those
watersheds specified above for fills of not more that one acre.
b. Proposed fill or substantial modification of greater than one-third

Carolina Division of Eavironniental Management (NCDEM), 25 NTU's in all
saltwater classes and all lakes and reservoirs and 10 NTU's in trout waters}.

d. Measures shall be taken to prevent live or fresh concrete from coming
into contact with waters of the State until the concrete has hardened.
e. Additional site-specific conditions may be added to this
Certification in order to ensure compliance with all applicable water quality
and efflueat standards.

Management (NCDEM) that this Certification apglies to an individual project
shall expire three gears from the date of the cover letter from the NCDEM.

GENERAr. corr~zTioNs
1.. Navigation. No activity may cause more than a minimal adverse effect on
navigation.
2. Proper Maintenance. Any structure or fill authorized shall be properly
maintained, including maintenanee to ensure public safety.
3. Erosion and Siltation Controls. Appropriate erosion and siltation
controls must be used and maintained in effective operating condition during
construction, and Ali exposed soil and other fills must be permanently
stabilized at the earliest practicable date.
4. Aquatic Life Movements. No activity may substantially disrupt the
~'~ movement of those species of aquatic life indigenous to the waterbody,
including those species which normally migrate through the area, unless the
activity's primary purpose is to impound water.
S. Equipment. Heavy equipment working in wetlands must be placed on mats or
other measures must be taken to minimize soil disturbance.
6. Regional and Case-by-case Conditions. The activity must comply with any
regional conditions which may have been added by the Division Engineer and any
case specific conditions added by the Corps.
7. xild and scenic Rivers. No activity may occur in a component of the
National Wild and Scenic River System; or in a river officially designated by
Congress as a "study river" for possible inclusion in the system, while the
river is in an official study status. Information on Wild and Scenic Rivers
may be obtained from the National Park Service and the Q.S. Forest Service.
8. Tribal Rights. No activity or its operation may impair reserved tribal
rights, including, but not limited to, reserved water rights and treaty
fishing and hunting rights.
9. Kates Quality Cartificatioa. In certain states, an individual state
water quality certification must be obtained or waived.
10. Coastal Soae l~tanagesteat. In certain states, an individual state coastal
zone management consistency concurrence must be obtained or waived.
11. Endangered Species. No activity is authorized under any NWP which is
likely to jeopardize thQ continued existence of a threatened or eadaagerad
species or a speciea proposed for such designation, as identified under the
Federal Endangered Species Act, or which is likely to destroy or adverselg
modify the critical habitat of such species. Non-Federal permittaes shall
cotify the District Engineer if any listed species or critical habitat might
be affected or is in the vicinity of the project and shall not begin work on
the activity until notified by the District Engineer that the requirements of

the Endangered Species Act have been satisfied and that the activity is
authorized. Information on the location of threatened and endangered species
can be obtained from the U.S. Fish and Wildlife Service and National Harine
Fisheries Service.
12. Historic Properties. No activity which may affect Historic Properties
listed, or eligible for listing, in the National Register of Historic Places
is authorized, until the District Engineer has complied with the provisions of
33 CFR 325, Appendix C. The prospective permittee must notify the District
Engineer if the authorized activity may affect any historic properties listed,
determined to be eligible, or which the prospective permittee has reason to
believe may be eligible for listing on the National Register of Historic
Place9~, and shall not begin the activity until notified by the District
Engineer that the requirements of the National Historic Preservation Act have
been satisfied and that the activity is authorized. Information on the
location and existence of historic resources can be obtained from the State
Historic Preservation Office and the National Register of Historic Places (see
33 CFR 330.4(q}),
13. Notification.
a. Where required by the terms of the NWP, the prospective permittae must
notify the District Engineer as early as possible and shall not begin the
activity:
(1) until notified by the District Engineer that the activity may
proceed under the NWP with any special conditions imposed by the District or
Division Engineer; or
(2) if notified by the District or Division Engineer that an
individual permit is required; or
(3) IInless 30 days have passed from the District Engineer's receipt
of the notification and the prospective permittee has not received notice from
the District or Division Engineer. Subsequently, the permittea's right to
proceed under the NWP may be modified, suspended or revoked only in accordance
With the procedure set forth in 33 CFR 33O.5(d)(2).
b. Ths notification must be in writirsq and include thQ following
information and any required fees:
(1) Hams, address and telephone number of the prospective permittee;
(2) Location of the proposed project;
(3) Brief description of the proposed project; the groject's purpose;
direct and indirect adverse environmental effects the project would cause; any

other NWP(s}, regional general persnit(s} or individual permit(s) used or
intended to be used to authorize any part of the proposed project or related
activity;
(4) Where required by the terms of the NWP, a delineation of affected
special aquatic sites, including wetlands; and
(5) A statement that the prospective permittee has contacted;
(a) The IISF'WS/NMFS regarding the presence of any Federally listed
(or proposed for listing) endangered or threatened species or critical habitat
., in the permit area that may be affected by the proposed project; and any
available information provided by those agencies. (The prospective permittee
may contact Corps District Offices for QSFWS/NMFS agency contacts and list of
critical habitat.) _
(b) The SHPo regarding the presence of any historic properties in
the permit area that may be affected by the proposed project; and the
available information, if any provided by that agency.
14. Hater Supply Intakes. No discharge of dredged or fill material may occur
in the proximity of a public water supply intake except where the discharge is
repair of the public water supply intake structures or adjacent bank
stabilization.
15. Shellfish Production. No discharge of dredged or fill material may occur
in areas of concentrated shellfish production, unless the discharge is
directly related to a shellfish harvest activity authorized by nationwide
permit.
16. 5w.tabls l~~taterial. No discharge of dredged or fill material may consist
of unsuitable material (a.q., trash, debris, car bodies, etc.) and material
discharged must be free from toxic pollutants in toxic amounts.
17. ititigatioa. Discharges of dredged or fill material into waters of the
Gaited States must ba minimised or avoided to the maximum extent practicable
at the project site (i.a., on-site), unless the District Engineer has approved
a compensation mitigation play for the specific raqulated activity.
18. Spawning llraas. Discharges is spawning areas during spawning seasons
must~be avoided to the maximum extant practicable.
19. Cbstructioas of Sigh lrlo~r:. To the maximum extent practicable,
discharges must not parmaaaatly restrict or impede the passage of normal or
expected high flows or cause the relocation of the water (unless the primary
purpose of the fill is to impound waters).

Nationwide Permit Numbers 14 and 26 when they are issued by the Corps of Engineers.

you change your project, you must notify us and you may be required to send us a new application.

The National Marine Fisheries Service has reviewed Pre-Discharge
Notification 199500688 dated December 5, 1994, whereby Landmark
Real Estate is ~~requestinq authorization for work pursuant to
Nationwide Permits #14 and #26. This project consists of filling
wetlands adjacent to an unnamed tributary of Topsail Creek for a
road crossing and the creation of a lot of sufficient size to allow
the construction of a single family residence in the Seven Pines
Subdivision, Pender County, North Carolina.
Based on our knowledge of the project area and a review of aerial
photography of the project site, we are concerned that the proposed
loss by filling of 0.84 acre of wetlands would be detrimental to
fishery resources for which we are responsible. Project area
wetlands are contiguous with the waters of Topsail Creek and are
vegetated with a variety of trees and herbaceous species including
red maple (Acer rubrum), sweet bay (Magnolia virginica), black
willow (Salix nigra), cinnamon fern (Osmunda cinnamomea), netted
chain fern (Woodewardia areotata), and royal fern (Osmunda
regalis). These wetlands provide important water quality
maintenance functions such as the interception of upland run-off

these pollutants can reach downstream waters. Topsail Creek, into
which run-off from the project area flows, provides important
nursery habitat for estuarine dependent species such as spot
(Leiostomus xanthurus), Atlantic croaker (Micropogonias undulates),
flounders (Paralichthys spp.), and Atlantic menhaden (Brevoortia
tyrannus).
We are also concerned that this work is associated with a new
subdivision with a portion of seven lots sited in wetlands along
the tributary. If similar work is proposed on these lots, the
result could be a cumulative loss of approximately 1.5 acres of
wetlands that support fisheries. Furthermore, no mitigation is
proposed to offset either the individual or potential cumulative
wetland losses associated with this project. Therefore, we feel

GENERAL CERTIFICATION
THIS GENERAL CERTIFICATION is issued in conformity with
the requirements of Section 401, Public Laws 92-500 and
95-217 of the United States and subject to the North
Carolina Division of Environmental Management Regulations in
15NCAC2H, Section .0500 for the discharge of fill material
to navigable waters or adjacent wetlands areas, occurring as
a result of minor road crossing fills as described in 33 CFR
330.5(a)(14) of the Corps of Engineers' regulations. This
category of activity shall include all road crossing fills
and attendant-features both temporary and permanent that
involve the discharge of less than 200 cubic yards of
material belpw the plane of ordinary or mean high water as
part of a single and complete crossing of a water body.
The State of North Carolina certifies that the
specified category of activity will not violate Sections
301, 302, 303, 306 and 307 of the Public Laws 92-500 and
95-217 if conducted in accordance with the conditions
hereinafter set forth.
Conditions of Certification:
1. That all road crossings be culverted or bridged to
prevent the restriction of normal flow of the
water body as a result of the discharge;
2. Excluded from this General Certification are
discharges of fill in waters classified WS I, II,
or III (public water supplies) and SA (shellfish
waters). This exclusion also applies to fill in
wetlands adjacent to these waters. Discharge
proposed for these waters or wetlands must be
considered for certification on a case-by-case
basis;
3. That the discharge will consist of suitable
material free from toxic pollutants in other than
trace quantities;

4, That established erosion control practices are
utilized to prevent excessive increases in
turbidity and settleable solids concentrations in
the water body as a result of the discharge.
5. That the discharge of fill material shall be in
accordance with the conditions and management
practices specified by the Corps of Engineers in
33 CFR 330,5 and 330.6 for nationwide permit
number 14.
Non-compliance with or violation of the conditions
herein set forth by a specific road fill project shall
result in revocation of this Certification for the project.
The Director of the North Carolina Division of
Environmental Management may require submission of a formal
application for certification for any project in this
category of activity, if it is determined that the project
is likely to have a significant adverse effect upon water
quality or degrade the waters so that existing uses are
precluded.
Public Hearings may be held for specific applications
or group of applications prior to Certification if deemed in
the public's best interest by the Director of the North
Carolina Division of Environmental Management.
