"Massengill" Pond Upgrades

Per telephone conversations between Jim Spangler, Brian Surak, and yourself
this memo is to serve as a statement of need for the upgrades to be performed at
the "Massengill" Pond. Development both upstream (resulting in a considerable
increase in stormwater runoff to the basin) and downstream of this existing
impoundment has substantially increased downstream risk in the event of
catastrophic failure of the dam. Moreover, an initial geotechnical investigation by
D. Miller and Associates indicates that the dam itself, as existing, is marginal as
to its stability.
In light of these circumstances, we deem it necessary to both upgrade the pond
outlet structure (in order to safely pass runoff from large storm events, with due
consideration of the runoff characteristics of' the developed watershed) and
upgrade the dam per recommendations by D. Miller and Associates. These
modifications will allow the pond to remain in place, while providing an
acceptable level of protection for the lives and property of those residing
downstream of the pond. We do believe that these planned upgrades are
imperative to the continued safe operation of this facility, and that a satisfactory
level of protection for the property and lives of downstream residents cannot be
maintained without the proper implementation of the proposed plan.
