Stevens Division of Water Quality CERTIFIED MAIL - RETURN RECEIPT REQUESTED June 25, 2001 North Carolina Golf Enterprises C/o Mr. Mark Black 4800 Six Forks Road, Suite 100 Raleigh, NC 27609 Dear Mr. Black; Subject: 401 Certification Request Sandler at Old Stage Wake County WQC # 001116, COE# 199920576 DWQ staff have received and evaluated the submittal dated April 23, 2001 (received April 30, 2001) from your consultant (Spangler Environmental, Inc.) which was in response to our letter of April 5, 2001. As you are aware, the Division and your consultant have corresponded five (5) times over the last ten months regarding 1) past, ineffective stream mitigation elsewhere on the property and 2) additional stream mitigation needed for the proposed impact. Unfortunately these responses have been unsatisfactory and these issues are still unresolved. Therefore in accordance with 15A NCAC 2H .0502 (c), we are unable to approve your request for 401 Water Quality Certification until you 1) propose a schedule to repair the past, ineffective stream mitigation and 2) propose suitable, compensatory stream mitigation for the additional, proposed impacts. Your application is hereby returned and will be reviewed again once the above information is submitted along with a new 401 Certification fee.
