Dear Madame/Sir:
The Division of Water Quality has reviewed the response by your consultant, Spangler Environmental, dated February 27,
2001 responding to correspondence from this Office dated February 9, 2001 regarding the incomplete application for a
401 Certification modification for the subject project. None of the responses provided by Spangler Environmental
adequately address the requirements for additional information provided in our February 9, 2001 correspondence.
1) This Office will not process your current application without a plan to repair the failing stream mitigation/relocation as
described in our February 9, 2001 correspondence. Failure to provide the above plan will result in this Office
proceeding to deny your application.
2) A site visit today, March 15, 2001 conducted by Staff from this Office confrimed that the streams proposed to be
culverted in the current application are perennial. As such, you must propose adequate mitigation to meet our
requirements. Preservation can only be used for 10% of a project's stream mitigation requirements. Failure to provide
an adequate mitigation plan will also result in this Office proceeding to deny your application.
