Dear Mr. Zaunick:
Please reference your revised Pre-Construction Notification application of May 8, 2007 for
Department of Army (DA) authorization to discharge fill material into 0.40 acres of
jurisdictional wetlands adjacent to facilitate the expansion of the 84 Lumber Blue Clay retail and
storage facilities in Wilmington, New Hanover County, North Carolina. The proposed project is
located along the eastside of Blue Clay Road, south of Hall Drive, in wetlands adjacent to an
unnamed tributary to Smith Creek, a tributary to the Northeast Cape Fear River, a navigable
Water of the United States.
In a letter dated June 1, 2007, this Office sent a detailed request, with a 30 day response
deadline, for additional information regarding more detailed site plans and your mitigation
proposal. On June 18, 2007, we received a letter from your agent, Land Management Group,
Inc.(LMG), that states that the information would be forthcoming. In my recent conversations
with Ms. Kim Williams of LMG, Inc., she stated that she has communicated with you about
the deadline. However, she also stated that she not received the information and direction from
you to enable her to respond to our letter. As such, we now consider your application withdrawn
and have closed the file.
