Hi David,
I have reviewed the BPDP submitted by you on 3/10/14 for the La Grange Phase II Expansion site in Lenoir County. I
have the following comments:
Appendix A: Figures were not included for this additional area. Which feature is being mitigated? a ditch? other
side of UT? Please include all items needed in Appendix A. The LaGrange Phase I Appendix A figures are
attached to this email for comparison.
Appendix B items were not included for this additional area. The conservation easement submitted for the
other LaGrange site (phase I) only included the 3.38 acre tract that has already been mitigated & accounted for
in the crediting. There will need to be another easement drafted for this additional area. the Stream
Determination letter still needs to be included. Keep in mind, that even though this is an expansion, it is being
treated as a completely new Bank that will have separate credit releases. It will have its own easement (or I
think you can modify the other one & include another plat to include this additional area, but that’s a legal
question I don’t know the answer to), its own monitoring reports (since it’s on a different monitoring schedule
than the other bank), its own financial assurance, etc.
Section 1.0: last paragraph. May want to also add that Katie Merritt w/ DWR visited the site in June of 2013 and
determined this additional area was still suitable for nutrient offset mitigation.
Section 3.0: see comments from email on 3/14/14 regarding planting of bald cypress
Section 6.0:

1 sentence says that it is “protected under a permanent conservation easement”. Is there another

conservation easement drafted and signed to include this additional 2.62 acres? If so, please provide
that. Otherwise, restate the sentence to say “it will be protected….”
my calcs give me 5,955.31 lbs-N instead of 5,728.01 lbs-N for a 2.62 acre tract.

3 sentence states that the credits will be generated along Meeting House Branch. Is this accurate, or is

it along a ditch, or is it along a UT to MHB? Maps you will provide in Appendix A will help with
understanding the location of the mitigation area.
