Dear Mr. Lund:
The U. S. Army Corps of Engineers (USACOE) has authorized the North Carolina
Department of Transportation (NCDOT) to place fill in waters of the United States for widening
construction of Section A of U.S. Highway 25 from SR 1528 to just north of I-26 in Henderson
County, North Carolina. This Section 404 Individual Permit authorizes the placement of fill
material and mechanized land clearing impacting a total of 1.11 acres of wetlands and 1,864
linear feet impacting Mud Creek, Three and One Half Foot Creek and unnamed tributaries and
adjacent wetlands. The purpose of this letter is to request a modification of the existing Section
404 Individual Permit.
NCDOT is requesting a modification at site 3 to eliminate the impervious dike labeled $
at the inlet end of the culvert and to permit the placement of sandbags and 60 linear feet of
temporary 36-inch diameter plastic pipe to provide diversion during culvert construction. All
sandbags, plastic pipe and other materials associated with the diversion will be removed at the
completion of the project and the stream will be routed through the extended culvert. This
diversion is needed to be able to complete extension of the culvert in a dry work environment.
NCDOT requests that the Section 404/401 Permit's be modified to reflect this additional
temporary impact to waters (Unnamed Tributary of Mud Creek -DWQ Class C) of the United
States. A diagram showing the proposed work at site 3 and a location map are attached.
