October 13, 2021 Mrs. Holley Snider NC Division of Water Resources 127 Cardinal Dr Extension Wilmington, NC 28405 Re: Response to DWR Request for Information Town of Carolina Beach Marina Renovation CAMA Major Permit Modification - PERMIT No 86-18 Carolina Beach, NC ARDURRA Group North Carolina is pleased to submit herein our response for the requested of additional information by Division of Water resources for the Modification to the Existing CAMA Major Permit No. 86-18 as an authorized agent for the Town of Carolina Beach. The request for additional information was dated September 14, 2021 and was provided to the Town of Carolina Beach and Ardurra via email on September 15, 2021. This letter serves as the response to the two items identified within that request for information. All additional information listed in the below is being incorporated into revised MP forms and a revised narrative and provided to NC Division of Coastal Management. This submission is to be provided to DCM no later than October 13, 2021. ITEM 1: AVOIDANCE AND MINIMIZATION This permit modification only applies to the south and east sides of the boat basin and does not attempt to modify the previously permitted dredge area on the western portion of the boat basin which has a permitted dredge depth of -11 NWL as indicated within CAMA Major Permit 86-18. The Town of Carolina beach has reviewed the vessels currently utilizing the south and east sides of the boat basin. Based on the provided vessel drafts, the Town will modify the proposed Ardurra Group North Carolina 3809 Peachtree Avenue, Suite 102 I Wilmington, NC 28403 I 910.397.2929 I www.ardurra.com DocuSign Envelope ID: B7D1 B5BC-82E7-47BF-8A65-5CEE625D019C October 13, 2021 Page 2 permitted dredge depth on the south and east side to a final dredge depth of -8 feet NAD83 (-6 feet plus -2 foot over dredge allowance). In summary the revised dredge quantity for the southern and eastern dredge areas to the depth outlined above is 1,150 CY to -6' NAD83 and 2,790 CY to -8' NAD83. ITEM 2: PROPOSED METHOD OF AND DISPOSAL OF DREDGE SPOIL The request for information requested additional information/clarification on the dredge methodology, disposal area, and possible contamination of spoil. Dredge Methodology Based on conversations with the Town, CAMA, DWR and prospective contractors, dredging will be completed by mean of mechanical dredging using an environmental "clamshell" style bucket. The dredge spoil will be placed in drying pens on the high ground contractor laydown more than 30 feet from the HWL. The laydown area is currently identified within the permit package and is located adjacent to Carl Winner Dr. Standard erosion and sedimentation control measures will be placed around the drying pens and the laydown area, as shown within the permit package drawings, to control stormwater runoff. Once the material has dried, the material will be transported to a permitted and approved disposal site by means of a dump truck with a debris cover. Disposal Area The Town will coordinate with the contractor to identify an approved and permitted disposal area that has sufficient volume and permitted to take the dredge material. For the most recent dredge completed in June of 2018 of 1,000 CY within the basin, the contractor reached an agreement and disposed of the material at the New Hanover County Landfill. Since the material proposed to be removed is of similar quality, and containing of similar levels and types of contaminants (see below), the Town has a reasonable expectation that an agreement with the NHC Landfill can be reached by the contractor or the contractor will be able to secure a consistent agreement with a private permitted spoil disposal area. Dredging activities would not commence until the permitted disposal site has been identified and CAMA and other permitting agencies have been notified and approval from the regulatory agencies received by the Town. Spoil Contamination The previous contractor and engineering team previously commissioned TI Costal to obtain and complete laboratory test samples within the Boat Basin and reference samples within the adjacent DocuSign Envelope ID: B7D1 B5BC-82E7-47BF-8A65-5CEE625D019C // October 13, 2021 Page 3 areas of the ICW. The dredge spoil was found to have contaminants listed within 40CFR 261.24, 40 CFR 261.30-261.33. The sampling locations and test results are attached. SUMMARY: Ardurra will update the appropriate CAMA major permit forms, the project narrative and the dredge volume calculations as directed by DCM, with the comments addressed within this response. These updates will be provided to DCM no later than October 13, 2021. The Town of Carolina Beach Commercial Marina has been in operation for nearly a decade, and the proposed repair, replacements, and improvements are necessary for the marina to continue to provide commercial water access for charter captains and their guests. The Town views DWR and DCM as important stakeholder in the project and will coordinate with DCM throughout the construction process.
