APPROVAL OF STORMWATER MANAGEMENT PLAN
Dear Ms. Flowers:
On February 22, 2013, the Division of Water Resources (DWR) issued a 401 Water Quality Certification
and Authorization Certificate per the Neuse River Buffer Protection Rules (15A NCAC 2B .0233) to place
fill within or otherwise impact the following:

In order to meet Condition 9 (stormwater management) of the Water Quality Certification and Buffer
Authorization for this project, a stormwater management plan (SMP) for Pod 6A, dated July 10, 2013,
was received on July 11, 2013. A revised stormwater management plan for Pod 6A, dated August 8,
2013, was received August 8, 2013.
The DWR approves the SMP for Pod 6A as meeting Condition 9 of the Water Quality Certification and
Buffer Authorization. This approval is for the purpose and design that you described in your application.
If you change your project, you must notify us and you may be required to send us a new SMP. This
approval requires to you follow the conditions listed in the Water Quality Certification and Buffer
Authorization for the project and the following additional conditions listed below:

1. The SMP approved by the DWR consists of one (1) wet detention pond and all associated stormwater
conveyances, inlet and outlet strictures, and the grading and drainage patterns depicted on plan
sheets dated July 24, 2013. The plans and specifications for Pod 6A approved by DWR are
incorporated by reference into this approval and are enforceable by DWR, provided however that
any modification of the design for the wet detention pond that is accepted by DWR shall take
precedence over the original plans and specifications.
The maximum allowable drainage area for the approved bioretention cell shall be 465,656 square
feet and the maximum allowable built -upon area within that drainage area shall be 169,500 square
feet. Built -upon area includes, but is not limited to, roofed structures, asphalt, concrete, gravel,
brick, slate, coquina and parking areas, but does not include raised, uncovered open slat decking or
the water surface of swimming pools. Any changes to these maximum areas shall require the
applicant to submit and receive approval for a revised stormwater management plan by the DWR.
3. The footprint of the wet detention pond as well as an additional 10 -foot wide area on all sides of the
devices shall be located in public rights -of -way, dedicated common areas or recorded easement
areas. The final plats for the project showing all such rights -of -way, common areas and easement
areas shall be in accordance with the approved plans.
4. Maintenance activities for the wet detention pond shall be performed in accordance with the
notarized 0 &M agreements signed by you on July 31, 2013. The O &M agreement must transfer with
the sale of the land or transfer of ownership /responsibility for the BMP facility. DWR must be
notified promptly of every transfer.
5. The applicant and /or authorized agent shall provide a completed Certificate of Completion form to
the DWR within thirty (30) days of project completion (available at
http: / /portal.ncdenr.or / web /wq /swp/ws/ 401 /certsandpermits /apply /forms).
