Duke requested that NCDWQ place a hold on processing the 401 WQC application for the Franklin Project until the final disposition of the Dillsboro Hydroelectric Project No. 2602 is resolved with both the NCDWQ and the Federal Energy Regulatory Commission (FERC). The license surrender application for the Dillsboro Project was filed with FERC on May 28, 2004. Since the one-year timeframe that FERC allows states to process 401 WQC applications expires on June 26, 2007 for the Franklin Project, Duke hereby withdraws the previous 401 WQC application that was filed and stamped received with NCDWQ on June 27, 2006 and is simultaneously requesting that NCDWQ use the data submitted with the previous application for processing the new 401 WQC application to NCDWQ for the Franklin Project. Enclosed is the application fee of $475 for the Franklin Project. Even though the license surrender application for the Dillsboro Project has been filed with FERC and NCDWQ has issued a 401 certification for the license surrender and removal of the Dillsboro Dam and Powerhouse, Duke is requesting that the NCDWQ place the processing of the Franklin Project 401 WQC application requested with this www.duke-energy.com cover letter on hold again until the final disposition of the Dillsboro Project is resolved with FERC.
