Hi David,
I just left a message for Patrick and then saw that your email requested that if I had questions, to contact youO I just
finished my final review of the subject restoration plan, and Item 1(b) from my comments below was not adequately
addressed in the revised plan. DWQ requires that a conservation easement be placed on the restored buffer. Please
add a statement that says this will happen or attach a signed conservation easement to this plan. If you need a template
for the easement, I am happy to provide that for you. In addition, that conservation easement will have to be
transferred to an approved land trust or stewardship fund at the end of the site's success. The existing statement
provided by S &EC says that you will "attempt" to do this. Can you please provide a written explanation as to why S &EC
feels this might not be achieved? At this time, there is at least one approved non - profit stewardship that has accepted
projects less than 2 acres (this one is 2.45). DWQ cannot approve of this restoration plan without the perpetual
protection addressed more adequately.
In addition, one more item needs to be addressed in the monitoring section. Please revise the statement in the first
sentence of the 5`h paragraph to read as follows: "Monitoring frequency will be annually for the required five (5) year
duration r until DWQ has determined success has been achieve '.
Everything else appears to be okay with the plan, and your cooperation is highly appreciated. Please don't hesitate to

Ms. Merritt,
Please find attached the resubmittal of the Hwy 70/581 Buffer Restoration Plan, revised as per the December 20, 2012
Request for Additional Information. As requested, two (2) hard copies of this plan will be mailed.
Specific changes addressed are as follows, in bold.
1. Resubmit the plan to include the following:
a. Provide a monitoring plan.
Monitoring and reporting as per 15A NCAC 02B 0242 (9g) is now referenced in the letter report under
the "Future Monitoring & Maintenance" paragraph. This section includes proposed quantitative and
qualitative monitoring methods as discussed via e-mail between yourself and Patrick Smith of our
office.
b. Provide a perpetual conservation easement.
We have addressed the conservation easement in the letter report.
2. Address the following items within the "Planting Specifications and Detail' on Sheet 4 and within the text of the
restoration plan (pages 1 -2) where applicable:
a. Maintenance: Fertilization is not recommended......
Fertilizer has been removed from the list of maintenance activities.
b. Modify the vegetation plan to address the following:
i. Trees should be planted at a density sufficient to provide 320 trees per acre at maturity.......
However, Loblolly Pine is not considered an acceptable tree for planting within the buffer.
Loblolly Pine has been removed from the planting list.
ii. Shrubs should be planted at a density sufficient to provide 1,200 shrubs per acre and are
optional in the vegetation plan.
Shrubs have been removed from the planting list.
iii. Substitutions to the species selected for planitng must be approved in advance by the Division
DWQ is now listed in the report and drawings instead of the Engineer.
