Post Office Box 2063 Goldsboro, NC 27533 Subject Property: Sheetz Project UT to Little River [030834, 11-1374, C] APPROVAL OF STORMWATER MANAGEMENT PLAN Dear Mr. Weil: On February 13, 2008, the Division of Water Quality (DWQ) issued a revised 401 Water Quality Certification to impact 0.96 acre of 404 Wetlands and 570 linear feet of streams for the purpose of redeveloping a commercial site. Condition 7 of this certification requires that a stormwater management plan be submitted to and approved by the DWQ. On January 14, 2013, the DWQ received a stormwater management plan (dated January 14, 2013) and additional information on February 14, 2013 (dated January 14, 2013) for the Sheetz parcel of this development from your consultant, Mr. Patrick Smith, PE, of Soil and Environmental Consultants, PA. The DWQ approves the SMP as satisfying Condition 7 of the General Water Quality Certification for this particular parcel ( Sheetz). This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new SMP. This approval requires you to follow the conditions listed in the General Water Quality Certification for the project and the following additional conditions listed below. 1. Stormwater Management Plan (SMP) Approval by DWQ for High Density Projects a) The SMP approved by the DWQ consists of one stormwater wetland and all associated stormwater conveyances, inlet and outlet strictures, and the grading and drainage patterns depicted on plan sheets dated January 14, 2013, which are incorporated by reference into this approval and are enforceable by DWQ provided however that any modification of the design for the stormwater management system that is accepted by DWQ shall take precedence over the original plans and specifications. 1617 Mad Service Center, Raleigh, North Carolina 27699 -1617 Location. 512 N. Any changes to these maximum areas shall require the applicant to submit and receive approval for a revised stormwater management plan by the DWQ. c) The footprint of all stormwater management devices as well as an additional 10 -foot wide area on all sides of the devices shall be located in either public rights -of -way, dedicated common areas or recorded easement areas. The final plats for the project showing all such rights -of -way, common areas and easement areas shall be in accordance with the approved plans. d) Maintenance activities for the stormwater wetland shall be performed in accordance with the notarized O &M agreements signed by Mr. Joseph S. Sheetz (Executive Vice President of Sheetz, Inc.) on February 5, 2013. The O &M agreement must transfer with the sale of the land or transfer of ownership /responsibility for the BMP facility. DWQ must be notified promptly of every transfer. e) The applicant and/or authorized agent shall provide a completed Certificate of Completion form to the DWQ within thirty (30) days of project completion (available at http://portal.nedenr.oro/web/Wg/swp/ws/40 I/certsandpermitL/appl /fy orms.)
