Director December 20, 2012 Dee Freeman Secretary DWQ # 2003- 0065v2 Wayne County Subject: REQUEST FOR ADDITIONAL INFORMATION Rosewood Industrial Park, Hwy 70 and 581, Buffer Restoration Plan Dear Mr. Martin: On December 17, 2012, the Division of Water Quality (Division) received the buffer restoration plan for the subject project dated December 2012, and the request for approval from the Division as required per the 401 Water Quality Certification and Buffer Major Variance approved on February 13, 2008. The Division has determined that the buffer restoration plan is incomplete. The Division cannot approve of the restoration plan until all of the following information is received: Item 9 of the 401 Water Quality Certification states that "The buffer mitigation plan must include plans and specifications according to 15A NCAC 028.0242 (9) ". 1. Resubmit the plan to include the following: Provide a monitoring plan. "Annual reports shall be submitted for a period of five years after the restoration or enhancement showing that the trees planted have survived and that diffuse flow through the riparian buffer has been maintained" Provide a perpetual conservation easement. Other protective mechanisms will not be accepted. 2. Address the following items within the "Planting Specifications and Detail" on Sheet 4 and within the text of the restoration plan (pages 1 -2) where applicable: a. Maintenance: Fertilization is not recommended within the riparian buffer due to unnecessary nutrient loading to surface waters. Please specify what fertilizers are expected to be used and how nutrient loading will be addressed. b. Modify the vegetation plan to address the following: i. Trees should be planted at a density sufficient to provide 320 trees per acre at maturity. However, Loblolly Pine is not considered an acceptable tree for planting within the buffer. Remove this tree from your planting list ii. Shrubs should be planted at a density sufficient to provide 1,200 shrubs per acre and are optional in the vegetation plan. iii. Substitutions to the species selected for planting must be approved in advance by the Division. An engineer's approval may be considered in the Division's approval. iv.
