I explained to him that Jeff Nimmer is the Vice President for Kotis Properties, Inc., who will be the developer of the proposed project for which the buffer impacts have been applied. The property owner, Kotis Garner, LLC is basically one in the same as Kotis Properties, Inc as most developers set up different LLC's for various properties that they purchase for future development. Ian explained to me that this was fine, and that he just needed a memo of some sort explaining why Jeff Nimmer's signature is valid for the PCN application for these buffer impacts. With regard to the above - referenced project, we offer the following remarks. Our comments are submitted pursuant to, and in accordance with, provisions of the Endangered Species Act. Based on the information provided and other information available, it appears that the proposed action is not likely to adversely affect any federally- listed endangered or threatened species, their formally designated critical habitat, or species currently proposed for listing under the Act at these sites. We believe that the requirements of section 7(a)(2) of the Act have been satisfied for your project. Please remember that obligations under section 7 consultation must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. However, the Service is concerned about the potential impacts the proposed action might have on aquatic species. Aquatic resources are highly susceptible to sedimentation. Therefore, we recommend that all practicable measures be taken to avoid adverse impacts to aquatic species, including implementing directional boring methods and stringent sediment and erosion control measures. An erosion and sedimentation control plan should be submitted to and approved by the North Carolina Division of Land Resources, Land Quality Section prior to construction. Erosion and sedimentation controls should be installed and maintained between the construction site and any nearby down - gradient surface waters. In addition, we recommend maintaining natural, vegetated buffers on all streams and creeks adjacent to the project site. The North Carolina Wildlife Resources Commission has developed a Guidance Memorandum (a copy can be found on our website at (http: / /www.fws.gov /raleigh) to address and mitigate secondary and cumulative impacts to aquatic and terrestrial wildlife resources and water quality. (ESI) conducted an on -site meeting with Crystal Amschler of the U.S. Army Corps of Engineers ( USACE) on August 26, 2008 to review the jurisdictional delineation for the Garner Tract in Wake County, NC. Ms. Amschler verified the delineation of streams STA and SCA. An additional stream channel (STB) located along the southern boundary of the property identified by PIN# 1701667637 was deemed to be jurisdictional. Stream STB is not depicted on the USGS topographic map or the NRCS soil survey map and will not subject to the Neuse River Riparian Buffer Rules per the N.C. Division of Water Quality (DWQ). However, the three features are subject to USACE Section 404 jurisdiction. If impacts to these features are proposed, Ms. Amschler indicated that the USACE would approve a 1:1 mitigation ratio due to the low quality of these features. Ms. Amschler also indicated that the existing preliminary site plan submitted would need to be altered to demonstrate that all practicable efforts to minimize unavoidable impacts to the features were taken prior to authorizing a NWT. As discussed in the report, we recommend that the proposed parking area be redesigned such that it merely crosses the stream and buffer to satisfy the USACE permitting and the DWQ Neuse River Riparian Buffer Rule requirements. I have attached an aerial map with the approximate extent and location of these jurisdictional streams. Division of Water Quality (DWQ) review for the approximately 3.4 -acre Garner Tract in Wake County, North Carolina. The project study area consists of Wake County PIN# 1701667637 and a portion of PIN# 1701665922. The project study area is located adjacent to the south side of U.S. 70 and to the west side of Timber Drive (SR 2812) and is within the Neuse River Basin. The Soil Survey of Wake County, North Carolina identifies three (3) soil mapping units as potentially occurring on the site. None of the identified soil mapping units are considered to be hydric soils. Wetlands and Streams The project study area was reviewed on 20 June 2008 to document the presence or absence of jurisdictional wetland areas subject to federal jurisdiction under Section 404 of the Clean Water Act. The area was assessed using the three - parameter approach (hydric soils, hydrophytic vegetation, and evidence of jurisdictional hydrology) as outlined by the U.S. Army Corps of Engineers (COE) 1987 Wetlands Delineation Manual. No wetlands were documented as occurring within the project study area. The project site was also reviewed for the presence of jurisdictional stream channels using additional criteria provided by the COE and the DWQ. Two (2) jurisdictional stream channels were delineated within the project study area. Stream SCA is located on the property identified by PIN# 1701665922. Stream STA is located along the northwest boundary of the property identified by PIN# 1701667637. Figure 1 depicts the approximate extent and location of these jurisdictional streams and can be used by your surveyor when locating the flags. It is our understanding that the jurisdictional delineation will be located by traditional survey. The streams were delineated with sequentially numbered blue & orange flagging. The jurisdictional delineation effort should be reviewed by the USACE prior to impacting any jurisdictional areas. Unavoidable impacts to Section 404 jurisdictional areas will require Section 404 and Section 401 permitting. ESI is currently scheduled to review the project study area with COE on July 10. Neuse River Riparian Buffers The Neuse River Riparian Buffer Rules (Buffer Rules) place a restriction on certain development within 50 feet of stream channels and surface waters that are depicted on the most recent version of the U.S. Geological Survey (USGS) 7.5- minute quadrangle map or on the Natural Resource Conservation Service (MRCS) county soils map (i.e. Soil Survey of Wake County, North Carolina). The riparian buffer consists of two distinct zones. Zone 1 comprises a 30 -foot wide area adjacent to the surface water that cannot be disturbed except for those specific activities that are allowed by the Neuse River Riparian Buffer Rules. Zone 2 comprises a 20 -foot wide area adjacent to Zone I that is to be left undisturbed except for those specific activities allowed by the Buffer Rules. Grading and re- vegetating Zone 2 is allowed provided that the condition of Zone I is not compromised. ESI met with Lia Gilleski of DWQ on 30 June 2008 to review onsite stream origins and to assess applicability of the Buffer Rules for the two mapped features. Stream STA is depicted on both the USGS topographic map and NRCS soil survey map and will be subject to the Buffer Rules per DWQ. Stream SCA is depicted on the NRCS soil survey map and will also be subject to the Buffer Rules per DWQ. DWQ flags were tied at the origin points for the two streams. Most impacts to Neuse River Riparian Buffers require prior approval from DWQ; however, impacts to Zone 1 for a proposed parking lot are prohibited according the Buffer Rules. Based upon the preliminary site plan that you provided, a Major Variance granted by the Environmental Management Commission (EMC) would be required for the proposed Zone 1 buffer impacts. A Major Variance is a costly and time consuming endeavor and we typically encourage our clients to avoid the procedure if at all possible. We recommend that the proposed parking area be redesigned such that it merely crosses the stream and buffer. Road crossings that impact equal to 40 linear feet or less of riparian buffer are exempt from the Buffer Rules and road crossings that impact equal to or less than I50 linear feet or less or one -third of an acre of riparian buffer are allowable with written authorization from DWQ. If the parking area can not be redesigned due to factors that we are not aware of; then we can discuss the Major Variance option and identify in greater detail the regulatory hurdles that will undoubtedly be encountered. The features are labeled as "A" and "B ", on the attached maps initialed by Lia M. Gilleski on August 21, 2008. The Division of Water Quality (DWQ) has determined that the following: Feature "A" is subject to the Neuse Buffer Rule at the flag labeled, "A1" (Intermittent Stream begins). Feature "B" is subject to the Neuse Buffer Rule at the flag labeled, "B I" (Intermittent Stream begins) at the Hwy 70 culvert outlet. This on -site determination shall expire five (5) years from the date of this letter. Landowners or affected parties that dispute a determination made by the DWQ that a surface water exists and that it is subject to the buffer rule may request a determination by the Director. A request for a determination by the Director shall be referred to the Director in writing c/o Cyndi Karoly, DWQ 401 Oversight/Express Review Permitting Unit, 2321 Crabtree Blvd., Raleigh, NC 27604 -2260. You must act within 60 days of the date that you receive this letter.
