The North Carolina Department of Transportation ( NCDOT) proposes a modification to
the existing Individual Section 404 Permit and 401 Certification for the I 3803B project
I 3803B is approximately 7 0 miles long from south of Concord Mills/Bruton Smith
Boulevard to NC 73 in Cabarrus County The project construction contract was awarded
in July 2010 and construction began when all permits were obtained in September 2011
Enclosed with this modification letter are updated permit drawings and an updated
summary impact table
Modification
This modification is being requested due to an inadvertently missed jurisdictional
wetland and stream at approximately Sta. 25 along Y6 (Poplar Tent Road) This area had
apparently been flagged previously due to flagging noted on site however, was not
included in the Natural Resources Technical Report or WET file used to create the plan
sheets for the project The nearest jurisdictional impact is located at Site 19 near Station
31 on Y6 The new' stream is a side channel from UT 14A (as noted in the NRTR) and
is approximately 108 feet long before tying back into the main channel The stream is
approximately 2 feet wide and currently has a good base flow The wetland noted in the

area is adjacent to the new stream boundary and had all criteria necessary to be
considered a junsdictional wetland
This modification includes impacts to both the stream and wetland due to the fill slope
for the road Because of the potential for the side channel to impact the fill slope, rock
toe protection is being added at the bottom of the fill slope It is anticipated that the
placement of the rock will essentially cut the side channel off entirely and restrict
hydrology to the wetland No impacts to the main channel are anticipated
The impacts will include 108 linear feet of stream and 0 02 acres of wetland based on a
total take of both resources The project s permit impact summary table has been
updated to include these impacts as well as the permit drawing This impact area is being
referred to on the permit drawings and summary impact table as Site 21
Mite g tion
Compensatory Mitigation will be required for the impacts noted within this modification
and the NCDOT has a surplus mitigation for this protect that was obtained previously
through the North Carolina Ecosystem Enhancement Program (see attachment)
REGULATORY APPROVALS
Section 404
Request is hereby made for a modification to the USACE Individual 404 Permit as
required for the above described activities
Section 401
We are hereby requesting a modification to the 401 Water Quality Certification from the
N C Division of Water Quality In compliance with the NCAC Section 143 215 31)(e),
we will provide payment for processing the Section 401 permit modification previously
noted in this application and the charge can be made to the State Project Number for this
project (See Subject line)

Subject EEP Mitigation Acceptance Letter
I- 3803B, 185 Widening from 1-485 to NC 73 Cabamns County
The purpose of this letter is to notify you that the Ecosystem Enhancement Program (EEP) will
provide the compensatory stream and riparian wetland mitigation for the subject project. Based on the
information supplied by you on April 7 2010 the impacts are located in CU 03040105 of the Yadkin River
Basin in the Southern Piedmont (SP) Eco Region, and are as follows
EEP commits to implementing sufficient compensatory stream and riparian wetland mitigation
credits to offset the impacts associated with this project by the end of the MOA Year in which this project is
permitted, in accordance with Section X of the Amendment No 2 to the Memorandum of Agreement
between the North Carolina Department of Environment and Natural Resources the North Carolina
Department of Transportation, and the U S Army Corps of Engineers fully executed on March 8 2007 If
the above referenced impact amounts are revised, then this mitigation acceptance letter will no longer be
valid and a new ntigation acceptance letter will be required from EEP
