P,~~Tn?~~'4`~AT~P,?RA.~IGH Per your request for additional information dated on April 25th, 2007 regarding the Kingfish Bay Development in Brunswick County. Listed below is discussion of each issue in your letter dated Apri125"', 2007. 1) Impact area 4 is needed to provide access to the proposed building. The design of the proposed access road is necessary to facilitate traffic flow and emergency vehicle access. Parking will be located under the proposed building. 2) Multiple access/egress points are not feasible due to the adjacent properties to the east and west being under private ownership. Access to the property is only available from NC Hwy 179 on the north side of the property. Wetland impacts have been minimized by utilizing existing road crossings and minimal side slopes/retaining walls. The applicant explored the possibility for bridging, but due to the cost analysis, concluded that it was not feasible. 3) In addition to providing access to uplands, this proposed impact is needed to create a circular driveway that will provide access to parking underneath the building. Even if the road was moved to the uplands between W30 and W107, this wetland impact would still be needed to create this circular driveway. Furthermore, the proposed building and driveway could not be moved further west without creating additional wetland impacts from grading. Engineered grading limits have been determined to provide no additional impacts to wetlands onsite. 4) Limits of proposed disturbance have been established outside of all wetland limits except where previously noted. 5) All proposed wetland impacts have been shown on submitted plans. Utilities will be installed within the road right of way to avoid additional impacts. 6) 48" culverts will be installed at the stream crossings to maintain connectivity and allow biological passage. Culverts will be buried 12" below ground to maintain a natural bottom. 7) Onsite stream restoration or creation is not possible due to several factors. No formerly impacted streams exist on site, and all existing streams are in good condition. Please note that the non-impacted streams and wetlands located on site will be preserved in perpetuity, and the EEP has agreed to provide necessary mitigation for the proposed impacts.
