The North Carolina Department of Transportation is requesting a modification to
Department of the Army Permit No 199707161 Department of the Army (DOA) Permit No
199707161 was issued on May 4 1998 and authorized impact by fill or excavation to 132 acres
of wetland and 13 461 linear feet of stream channel In July of 2001 the NCDOT requested that
the expiration date for the DOA Permit No 199707161 be extended to July 1 2003 The
requested extension was granted by letter dated October 2 2001
Since the date the extension was granted an overrun in the amount of waste generated by
the project has occurred There is currently 200 000 cubic yards of material that will be removed
from the project and placed in a waste area The contractor has identified a suitable waste area
adjacent to the project However, the proposed waste area contains two small jurisdictional seep
wetlands
It has long been the policy of the NCDOT not to allow waste or borrow activities in
jurisdictional areas except in extraordinary situations The NCDOT and its contractors have
searched for an alternative disposal site within a reasonable distance to the project There are
sites that could be used that would not affect wetlands However there are no economically
feasible sites The proposed site is the only site available in close proximity to the project where
off road trucks may be used to haul the material

As stated earlier there is approximately 200 000 cubic yards of material to be disposed
of Due to the location of the area that the material will be removed from and the current phase
of project construction avoiding the two small wetlands would require hauling the material via
standard highway dump trucks Because the highway trucks cannot carry the same amount of
material as the off road trucks it would take many more trips to dispose of the material The
additional trips would increase the cost from $3 00 per cubic yard to $6 00 per cubic yard For
an estimated 200,000 cubic yards this means an additional $600 000 in disposal costs
The two small wetlands are seeps immerging from a hillside slope within the proposed
waste area The seeps encompass 1 807 square feet (0 04 acres) Avoiding this 1/24 of an acre
of wetlands at a °cost of $600 000 would mean that these wetlands have an equivalent value of
$14 463 752 00 per acre
The NCDOT is therefore proposing to utilize the area that contains the two small
wetlands as a waste dis' saharea The NCDOT feels that the 26 2 acres of preservation that has
been previously allocated for this project from the Sparta Bog Mitigation Site is appropriate
compensation for the original 1 32 acres and the additional 0 04 acres The original compensation
amounted to a preservation ratio of 19 8 to 1 The additional impact of 0 04 acres would only
reduce this ratio to 19 2 to 1 Therefore the NCDOT does not propose additional mitigation
