Dear Mr. Johnson:
As youmay be aware, the Division of Water Quality (DWQ) has received various complaints
from homeowners in the Seascape at Holden Plantation development concerning the status of the
depressional wetlands/ponds located between Seascape Boulevard South and Versailles
Boulevard otherwise commonly referred to as the "Lower Pond". On March 19, 2010, the DWQ
issued a Notice of Violation (NOV) to Seascape at Holden Plantation, LLC for violations of 15A
NCAC 02B.0231 (Wetland Standards).
Since the issuance of the NOV, the DWQ has been working with Seascape at Holden Plantation,
LLC and it's representatives, the U.S. Army Corps of Engineers (USACE), and the experts from
the Division of Water Resources (DWR) to resolve the complaints and violations regarding the
Lower Pond. After reviewing the information gathered to this point, it is our belief that the
underdrain system with perforated pipes has adversely impacted the hydrology of waters of the
U.S., resulting in impacts to the wetland's existing uses. To determine the exact impact to the
wetlands and to determine the best course of action to restore the proper hydrology to the
wetlands, the DWQ is preparing to install approximately fifteen (15) groundwater monitoring
wells in the general area of the Lower Pond. These wells will be installed into the shallow
unconfined aquifer and are intended to be temporary monitors of the water table. At this time,
the locations of the wells have not been finalized; however, the DWQ would like to locate many
of these on property that is owned by the Property Owner's Association (POA). As such, we are
requesting formal permission from the POA to install these wells. Please see the attached map
for the current locations of the proposed wells. The period of time required for the well
installation should not be longer than one week. These wells will be monitored periodically after
installation by DWQ field staff until enough data is gathered to provide more exact evidence of
the impact that the underdrain system is having upon the groundwater levels.

We would like to begin the installation of the wells as soon as is possible so that we can resolve
the issues that are present with the Lower Ponds. Please send a written response to this letter
within 15 calendar days of receipt. We would appreciate your aid and cooperation in this matter.
