Oak Island Drive Oak Island, NC 28465 Subject Property: Town of Oak Island Wastewater Collection System Sewer System Phase I REQUEST FOR MORE INFORMATION Dear Mr. Walters: On December 6, 2007, the Division of Water Quality (DWQ) received your application dated October 2, 2006 to impact 27 square feet of Coastal Wetlands and 625 square feet of open water to construct the proposed wastewater collection system. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Wetland Jurisdictional Determination Please provide a copy of the wetlands delineation map for the project area that has been signed by the U.S. Army Corps of Engineers (USAGE). A copy of the wetland survey that has been field verified by an USAGE Representative is satisfactory at this time. 2. Avoidance and Minimization The NC Division of Marine Fisheries (DMF) and the NC Wildlife Resource Commission has concerns associated with trenching the cut across Davis Canal. This area is designated Primary Nursery Area by the DMF. Please propose to directionally drill at this location or provide the data to support that directionally drilling at this location is not economically feasible. Indirect and Cumulative Impact Study Please perform and provide an indirect and cumulative impact study for the proposed project. Although the project narrative does state that no new roads will be built and no new property will be platted, DWQ has concerns related to wetland lots becoming buildable as a result of the proposed wastewater collection system and the protection of downstream waters via engineered stormwater treatment systems. For example, please describe the number of lots (and area of land) that have jurisdictional wetlands present and are not buildable unless a municipal collection and treatment system is made available. In addition, please discuss the approximately density of the future areas that will be built on as a result of a new system and how stormwater treatment will be addressed. Please respond within three weeks of the date of this letter by sending this information to me in writing and 5 copies of this information to Cyndi Karoly of the DWQ Wilmington Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
