Dear Mr. Thomas:
This letter provides an update on the stream restoration/mitigation project and the associated conservation
easements required by the above referenced permits. These permits require the following mitigation: 1) a
conservation easement for a 38.4 acre buffer along Rocky Branch (Chatham County), and 2) a conservation
easement for a 13.5 acre area on the Moncure site (Lee County), which includes 3215 linear feet of
proposed stream restoration.
The North Carolina Wetlands Restoration Program (NCWRP) has accepted these permanent conservation
easements. Please see the enclosed "letter of intent" from NCWRP of 1/23/02. It is our understanding that
NCWRP is already an approved conservation organization. 3M is currently working to transfer these
conservation easements to the State Property Office, however some additional time is necessary for
preparation of legal documentation. The 404 permit special conditions (g) and (m) required approval of the
conservation organization within 6 months of permit issuance (8/24/01). Therefore, 3M is requesting a 60
day extension to this deadline in order to finalize and record easements. A copy of the recorded easements
will be sent to your office.
As for the status of the stream restoration work on the Moncure site, 3M is currently in the final stages of
construction/restoration contractor selection. As you know, there is a limited number of qualified
contractors for stream restoration work and their schedules are filled. 3M began the construction bidding
process after receiving the 404 permit, and we have spent the last few months selecting a qualified
contractor and negotiating terms of a contract. Once a contract is awarded, the contractor is planning for
stream restoration completion (constriction and plantings) by June 1, 2002. Therefore, 3M is requesting
an extension from the March 15, 2002 to June 1, 2002 for the stream restoration completion date. Once
this extension is granted, we will keep you informed of the construction start.
Please respond in writing to whether USACE has granted both deadline extensions prior to February 24,
