WAIVER OF TAR-PAMLICO RIVER BUFFER AUTHORIZATION CERTIFICATE
Dear Mr. Geewax:
Your After-the-Fact, Pre-Construction Notification (PCN) application dated April 11, 2010 for a
Authorization Certificate per the Tar-Pamlico Buffer Protection Rules (Buffer Authorization) was
received by the Division of Water Quality (DWQ) on April 20, 2010 with additional information received
on July 2, 2010 and November 12, 2010. According to our rules [15A NCAC 2B .0259(8)(b)], if final
action is not taken within 60 days, the Authorization Certificate is waived unless DWQ has objected in
writing to your application. Therefore, DWQ has waived the requirement for a Buffer Authorization for
your existing impacts of 1,650 square feet to Zone 1Tar-Pamlico River Buffer Protection Rules (1SA
NCAC 2B .0259) from the construction of a 550 feet in length by 3 feet wide wooden slatted walkway
parallel to the existing bulkhead as described in your application.
However, if additional impact occurs or your development plans change, this waiver is no longer valid
and a Buffer Authorization will be required.
