Dear Mr. Lewis:
This Office has reviewed your CAMA Major Application received by the Division of
Water Quality (DWQ) on March 17, 2003. The plans submitted with the application do not
clearly show the coastal wetlands/marsh delineated by the Division of Coastal Management
(DCM). If the area where you are proposing fill has been designated coastal wetlands by DCM,
Administrative Code Section: 15A NCAC 2H.0506(d)(1)(B) prevents the Division of Water
Quality from issuing a 401 Water Quality Certification for the fill of coastal wetlands unless the
project is water dependent and requires access to water as a central element of its basic function.
Please submit revised plans clearly delineating the coastal wetlands on your property. If
the area proposed for fill is within the coastal wetland boundary, please propose an alternative to
placing fill in this area.
Please respond within three weeks of the date of this letter by sending a copy of the
information to Noelle Lutheran and to Cyndi Karoly, 401 Wetlands Unit, 2321 Crabtree Blvd.,
Raleigh, NC 27604-226, her phone number is [phone]. If we do not hear from you within
three weeks, we will assume that you no longer want to pursue this project and we will consider
