Saunders Seascape At Holden Plantation, LLC 131 Ocean Boulevard, West Holden Beach, NC 28462 Subject: Seascape At Holden Plantation Brunswick County Dear Mr. Saunders: On August 15, 2010, the Division of Water Quality (DWQ) received your well monitoring report for the lower ponds (pond #2) at Seascape at Holden Plantation. On August 24, 2010, we met with the U.S. Army Corps of Engineers (USACE) to re-verify the previous wetland jurisdictional determination. On August 30, 2010, we met with representatives of the Seascape Property Owner's Association to hear additional concerns regarding the upper (pond #4) and lower ponds (pond #2) on the development. After reviewing the information in the well monitoring report, performing site investigations, and consulting with the experts from the Division of Water Resources (DWR), it is our belief that the underdrain system with perforated pipes has adversely impacted the hydrology of waters of the U.S., resulting in impacts to the wetland's existing uses. Moreover, we do not believe that the restoration plan presented in your report dated August 15, 2010, will provide adequate restoration of wetland hydrology. As such, the Division requests that you submit a restoration plan including a schedule for its implementation that will result in adequate restoration of historic wetland hydrology to the referenced ponds. In addition to providing restoration of wetland hydrology, it must comply with the plans and specifications in Stormwater Permit SW8990913 MOD issued as approved on April 02, 2008. Specifically where hard piping was approved south of pond #2, and perforated pipe was installed instead, the perforated piping must be removed and replaced with hard piping. In addition, please include in your restoration plan groundwater monitoring wells to track the progress of the restoration activities. Monitoring shall be implemented for a minimum of five years and include proposed success criteria for determining if appropriate wetland hydrology has been restored to the impacted waters. In addition, your plan should include contingency actions in the event that the monitoring demonstrates that the restoration plan is not working as anticipated to restore the hydrology to the wetlands. Also, the September 25, 2000, hydrogeological investigation report mentions installation of subsurface drainage in this area similar to that installed near the lower ponds (pond #2) that may be adversely impacting the hydrology to the wetlands. Please provide accurate drawings showing the type of piping that was installed is this area. If perforated piping was installed in this area, then a determination will be required to ascertain the effects the piping has had on the wetlands around the upper pond (pond#4). Finally, it appears (based on the previous jurisdictional determination) that unauthorized impacts to wetlands have occurred in other locations in the development. Division staff will be investigating these possible impacts in the near future. We would appreciate your aid and cooperation in this matter.
