Duke submitted Addendum 1 (Lake Level and Flow Management Plans) and Addendum 2 (Sediment Study Plan) to the North Carolina Division of Water Quality (NCDWQ) each under separate cover letters dated May 26, 2010. Subsequently, after discussions with resource agencies, Addendum 3 (Revised Sediment Study Plan) was submitted to NCDWQ under cover letter dated May 27, 2010. Addendum 3 superseded and replaced Addendum 2 in its entirety. The cover letter to Addendum 3 makes clear that it supersedes Addendum 2, but this would not necessarily be clear if the addenda were reviewed independently, apart from their cover letters. All these documents were submitted electronically to NCDWQ on these respective dates and hard copies were delivered to NCDWQ offices on May 28, 2010. Although the FERC staff was included in the carbon copy list of all submittals to NCDWQ, Duke neglected to a-file these documents with the FERC. Therefore, Duke is now providing the FERC with Addenda 1, 2, and 3, along with their cover letters. We apologize for this oversight. Duke is continuing to work closely with the NCDWQ staff to clarify the WQCs for the Nantahala Area Hydro Projects.
