Dear Mr. Jester:
On June 9, 2010, the NC Division of Water Quality issued 401 Water Quality Certifications for the
abovementioned six (6) FERC projects. The second to the last paragraph in each Certification' stated that
anyone who wishes to appeal the 401 conditions must file an appeal with the NC Office of Administrative
Hearings within 30 days of receipt of the Certification. Upon further review, the Division has determined
that this deadline should have been 60 (sixty) days from receipt of the Certification. This change is
hereby made in each of the six (6) Certifications listed above.
In addition, we have received proof of payment for the Public Notices for each of the
Certifications. Therefore the condition in the Certification that refers to payment of the public notices has
been satisfied for each of the six (6) Certifications.
