ROR projects. Still Duke is trying to not commit to long term sediment management. Tough. We have been saying that it must be done since Oct 2000. Our position has not changed. They still need to do it. And they need a final plan in 12 months. They've had 10 years to get on it, not they can get on it.... Storage Projects. Shoreline Management must be included. These are "sensitive" watersheds (water supplies and HQW / ORW, and Tr) and shoreline management is key to maintaining these designated uses. They must do it. Like me, I am sure you are glad that we have finally reached the point where we no longer need to withdraw and resubmit our Applications for Water Quality Certifications for these Projects each year. As you know, we were in discussions with several resource agencies all the way through the end of the public comment period and you have received quite a bit of input on the WQCs. As we reviewed the WQCs for these Projects, we came across a few things that we need to clarify and get your concurrence. With that goal in mind, I have attached 2 short documents (one for run-of-river projects and one for storage projects) listing the things we would like to confirm with you. This week, we'd like to have your informal advance review and feedback on these attachments. After we have had a chance to discuss your feedback with you and reconcile any comments, it is our plan to convert these into formal letters to DWQ to request written concurrence. Hopefully we can work together to achieve your written concurrence with these clarifications, as we did for the Catawba-Wateree Project, within 30 days after the WQCs were issued (July 9, 2010). If not, we may need to file for appeal so as not to lose that option. Such an appeal, if necessary, would be intended to allow us time to work out clarifications. Assuming that we are able to do so, we would plan to withdraw the appeal upon receiving your written concurrence with the clarifications. Thanks in advance John for considering these requests.
