The following restates your questions/comments and is then followed by our response. Additional Information Requested 1. Please provide documentation that DWQ or Forest Resources has made intermittent/perennial stream determinations on the site or contact DWQ to schedule intermittent/perennial stream determinations on the site. It is our understanding that part of your 60- day review process would include a site visit if you determine one is necessary. As part of the original delineation, both the USACE and DWQ staff were out to the subject property to review the streams and wetlands on site as well as making buffer determinations. Additionally, the proposed development was also the site of a violation of the USACE 404 Rules, the NC DWQ Wetland Rules (15A NCAC 2H .0500), the NC DWQTar-Pamlico Buffer Rules { 15A NCAC 2B .0259 (4)(b)} and the Sediment and Erosion Control standards administered by the Division of Land Quality and has been reviewed extensively by all three agencies. This project should not be removed from the reviewing process as the stream determinations have been made and are not necessary to complete the review the rest of the project as proposed.
