AND STOR?AWAX00CM The Corps will evaluate this application and decide whether to issue, conditionally issue, or deny the proposed work pursuant to applicable procedures of Section 404 of the Clean Water Act (33 U.S.C. 1344). Location The site is located at the existing Charlotte-Douglas Airport facility, on the south side of Old Dowd Road, adjacent to Minuteman Way, in Charlotte, Mecklenburg County, North Carolina. Coordinates for the site are: 35.244°N, -80.933°W. The proposed impact location is northeast of the intersection between the two existing runways. -1- Existing Site Conditions The site is approximately 15 acres in size and contains several different types of jurisdictional features. In general, the site has been disturbed due to past development activities associated with the construction and operation of the airport facility. The site contains intermittent and perennial stream channels that flow through existing wetlands on the site before ultimately draining into Sugar Creek, which is considered a Traditional Navigable Water. The intermittent portions of the streams was classified as seasonal relatively permanent waters and is generally degraded due to lack of riparian buffers, on-going erosion, and lack of in-stream habitat/macro-invertebrate life. These intermittent channels transitions to a perennial stream classified as a relatively permanent water which is also considered degraded for the same reasons. The total stream length on site is approximately 1,090 linear feet. The wetlands on the site total 2.12 acres and include both vegetated and open water habitat types. Approximately 0.26 acres is considered an emergent wetland with various species to include: bushy bluestem (Andropogon glomeratus), broomsedge (Andropogon virginicus), Nepal grass (Microstegium spp. ), and gold rods (Solidago spp. ). The remaining 1.86 acre of wetlands is a scrub/shrub vegetated wetland that transitions to open water habitat. Vegetation consists of black willow (Salix nigra), elderberry (Sambucus candensis), tag alder (Alnus serrulata), sycamore (Platanus occidentalis), bushy bluestem, and broomsedge. Applicant's Stated Purpose The purpose of the project as stated by the applicant is to construct a new taxiway on the east side of Runway 18L-36R to allow airplanes that are based on that side of the airfield to taxi to their takeoff position without crossing the active runway which reduce the risk of accidents and departure delays. Project Description In order to construct the taxiway, the applicant is proposing to fill approximately 149 linear feet of stream channel. No impacts to.wetlands are proposed. The proposed fill slopes and drainage system have been shifted to minimize impacts to jurisdictional features. All proposed impacts will occur to Stream A which was designated as an intermittent (seasonal relatively permanent water) stream channel. The stream will be filled by extending an existing culvert and then placing riprap at the downstream end of the new culvert. The applicant is not proposing any compensatory mitigation at this time. Also, please note that this permit request is associated with several previous permits that have been issued over the years for the expansion of the airport facility. Cumulative impacts that have been permitted on the site total 25,519 linear feet of stream channel, 4.183 acres of wetlands, and 7.552 acres of open water ponds. -2- Other Required Authorizations This notice and all applicable application materials are being forwarded to the appropriate State agencies for review. The Corps will generally not make a final permit decision until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act (PL 92-500). The receipt of the application and this public notice combined with appropriate application fee at the North Carolina Division of Water Quality central office in Raleigh will constitute initial receipt of an application for a 401 Water Quality Certification. A waiver will be deemed to occur if the NCDWQ fails to act on this request for certification within sixty days of the date of the receipt of this notice in the NCDWQ Central Office. Additional information regarding the Clean Water Act certification may be reviewed at the NCDWQ Central Office, 401 Oversight and Express Permits Unit, 2321 Crabtree Boulevard, Suite 250, Raleigh, North Carolina 27604-2260. Essential Fish Habitat This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson-Stevens Fishery Conservation and Management Act. The Corps' initial determination is that the proposed project will not adversely impact EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils or the National Marine Fisheries Service. Cultural Resources The Corps has consulted the latest published version of the National Register of Historic Places and is not aware that any registered properties, or properties listed as being eligible for inclusion therein are located within the project area or will be affected by the proposed work. Presently, unknown archeological, scientific, prehistoric, or historical data may be located within the project area and/or could be affected by the proposed work. Endangered Species The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest North Carolina Natural Heritage Database. Based on available information, the Corps has determined pursuant to the Endangered Species Act of 1973, that the proposed project will have no effect on federally listed endangered or threatened species or their formally designated critical habitat. -3- Evaluation The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefit which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, flood plain values (in accordance with Executive Order 11988), land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the discharge of dredged or fill materials in waters of the United States, the evaluation of the impact of the activity on the public interest will include application of the Environmental Protection Agency's 404(b)(1) guidelines. Commenting Information The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials, including any consolidate State Viewpoint or written position of the Governor; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Any person may request, in writing, within the comment period specified in this notice, that a public hearing be held to consider the application. Requests for public hearings shall state, with particularity, the reasons for holding a public hearing. DO j EH 4 1 + I May 14, 2010 Ms. Amanda Jones Asheville Regulatory Office United States Army Corps of Engineers 151 Patton Avenue Asheville, NC 28801-5006 Re: Individual Permit Application Charlotte Douglas International Airport CDIA Taxiway D Charlotte, Mecklenburg County, North Carolina Ms. Jones: HDR Engineering, Inc. of the Carolinas (HDR), on behalf of our client, the Charlotte-Douglas International Airport (CDIA) (Agent Authorization Form, attached), is requesting a Section 404 Individual Permit in order to construct the proposed CDIA Taxiway D project per USACE guidance. The USACE has requested an Individual Permit application for the proposed project since it is part of the ongoing CDIA improvements. A Section 401 Water Quality Certification was submitted on February 12, 2010 (NC DWQ Project Number: 00-1195v10). The proposed project is located in the City of Charlotte, Mecklenburg County, NC (Figures 1 and 2). CDIA proposes to construct a taxiway on.the east side of Runway 18L-36R to allow airplanes that are based on that side of the airfield to taxi to their takeoff position without crossing an active taxiway. The new taxiway will minimize the risk of accidents and help reduce departure delays. Once the taxiway is constructed, the existing museum hanger will lie within the required Object Free Area (OFA) and will become an obstruction to the proposed taxiway. The Federal Aviation Administration (FAA) defines the OFA as an area free of any objects that are above the taxiway centerline. The hanger will be moved approximately 200 feet to stay out of the OFA. A pedestrian survey for jurisdictional waters of the U.S. was conducted on January 19th and 26th, 2010 within the CDIA's property (parcel ID: 11522102). Jurisdictional waters were delineated and identified according to the methodology described in the USACE 1987 Wetland Delineation Manual and recent USACE Rapanos guidance. HDR identified on-site jurisdictional features as two stream channels or Relatively Permanent Waters (RPWs), one emergent wetland, and a scrub shrub/open water wetland (Figure 3). Representative features are attached. A request for verification of the features was forwarded to the USACE on February 8, 2010. The original plans included approximately 675 square feet of fill impacts to Wetland BB and approximately 181 linear feet (If) of fill impacts to Stream A. The revised plan accounts for 148.5 if of impact to Stream A, (126.5 If of fill from grading activities and 22 if of fill from the proposed rip rap apron). (Figure 4 and Figure 5). The installed culvert will be an extension of an existing pipe. No open waters are evident upstream. No mitigation is proposed since impacts to streams are minimal and impacts to wetlands have been completely avoided. Correspondence was sent to State Historic Preservation Office (SHPO) requesting information on any cultural resources that may be impacted by the proposed construction. After review, SHPO stated that no historic resources would likely be affected by the proposed project, dated March 4, 2010 (see attached). HDR has reviewed the U.S. Fish and Wildlife Service (USFWS) protected species list and consulted the North Carolina Natural Heritage Program (NCNHP) Elemental Occurrence database -and GIS layer for Mecklenburg County. An on-site protected species habitat survey was preformed in conjunction with the jurisdictional waters survey. The proposed project area is highly disturbed with a dense population of invasive species, notably kudzu (Pueraria montana var. lobata). As a result, no habitat for protected species was evident. HDR has requested comment from the U.S. Fish and Wildlife Service (USFWS) regarding these findings (February 8, 2010). At this time, no response has been received. The existing museum hanger currently lies within the Object Free Area (OFA) and will become an obstruction to the proposed taxiway. The hanger will be moved approximately 200 feet to stay out of the OFA. It is anticipated that normal grading equipment will be used. 19.
