Salisbury Street Suite 105 Raleigh, NC 27604 Wake Forest, NC 27587 Re: Corinth Village Project Request for NWP 29, GC 4139, and Riparian Buffer Authorization Sage Project #2018.39 On behalf of Corinth Village Partners, LLC (applicant and owner), please find attached a complete application and supplemental information requesting written concurrence from the US Army Corps of Engineers (USACE) that the activities associated with the proposed development of the Corinth Village property (Project) may proceed under Nationwide Permit (NWP) 29 and 401 certification (GC 4139) and riparian buffer authorization. A NWP 29 was requested under separate cover prior to the 30-day filing notice requirement from NCDWR. During that time, USACE provided comments, which are addressed in the attached Response to USACE Comments letter. The PCN application has been updated to reflect these changes and supplemental information has been provided. Project Site Information and Location The Site consists of two separate parcels. The northern parcel is +/-15.9-acres and the southern parcel is +/-33.7-acres. The northern Site is primarily forested and is surrounded by single-family residential development to the west, south, and east. An apartment complex and undeveloped forested land are located to the NE and NW, respectively. The southern parcel is forested in the eastern and western portions with a small pasture area located on the eastern side of the tract. Land adjacent to the parcel includes single-family residential subdivisions to the north, east and west along with undeveloped forested and agriculture land south of Neese Road. General land use in the vicinity includes rural and suburban residential, agricultural and pastureland, and undeveloped, forested land. Guilford County lists the parcel PINS as #7873-51-8136 & #7872-69-4409. The approximate center of the northern parcel is located at Latitude: 36.03182°N; Longitude: 79.75851 °W. Project Purpose and Detail The purpose of the Project is to provide additional housing for the area to meet current demand. The overall project consists of the construction of a single-family residential subdivision and associated utilities. Water and wastewater services will be connected to existing services nearby. Proposed roads will connect to adjacent �_orinzh Village Nrojecz Image i or 3 roadway stubs and will utilize existing crossing locations where possible. Heavy equipment typically used for utility installation projects (e.g. back hoes, bull -dozers, etc.) will be utilized. No federally threatened or endangered species are listed to occur within 1 mile of the Project according to the NC Natural Heritage Program (NHP) Database (see attached report dated September 24, 2020). A pedestrian survey for Schweinitz's sunflower and small whorled pogonia individuals was performed on October 15, 2020. No individuals were observed. Open areas are present in the edges of forested areas, but these areas were not regularly maintained to provide suitable habitat for Schweinitz's sunflower. Habitat for small whorled pogonia was not present on the Site. The Site is not listed as a historic property and is not within a historic district. There are six historic properties located within 1.0 mile of the Site based on a query of the North Carolina State Historic Preservation Office (NCSHPO) database. Four properties are designated as Study List (SO), one property (Holmes Grove Church, GF3000) is designated as Determined Eligible — Gone (DOED), and one property (Thomas Neese House, GF1223) is designated as Determined Eligible and is +/-0.35-mile east of the Site. Project History A delineation was completed prior to 2000 and impacts were permitted (SAW 2000-20928) for a stormwater pond and a road crossing. The stormwater pond was constructed but as per a discussion with Mr. David Bailey of the USACE, the road was apparently never installed. Sage Ecological Services completed a wetland, stream, and riparian buffer delineation on the Project in the summer of 2018. A preliminary jurisdictional determination request was submitted to USACE on July 8, 2020, and a site meeting was then held with Mr. David Bailey of the USACE, Ms. Sue Homewood of the NCDWR, and Mr. Sean Clark of Sage on August 5, 2020. The attached maps reflect the determinations made during the site meeting. A previous NWP 14 and NWP 26 were obtained for the southern parcel stormwater pond (SAW 2000- 20928). A NWP 29 was requested from USACE on September 25, 2020. Mr. David Bailey provided comments via e-mail. Our Response to Comments letter is included as an attachment. Avoidance and Minimization The proposed subdivision roads and lots were aligned so as to avoid and minimize impacts to wetlands, streams, and riparian buffers as much as possible. Previously planned Lots 39 and 40 were eliminated to reduce wetland impacts in this area. Previously, the sewer outfall alignment at Impact 3 was realigned to greatly reduce wetland impacts and avoid additional Zone 2 buffer impacts. The previously planned lots 99 and 100 have been eliminated to avoid buffer and stream impacts, and further design changes have eliminated Zone 1 buffer impacts in this area. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts. Silt fencing will be installed to provide additional protection from runoff. Project Impacts Proposed permanent wetland impacts total 0.27 acre (previously 0.28 ac) as a result of road crossings, lot fill, and utility easements. No temporary wetland impacts are proposed (previously 0.03 ac). Proposed stream impacts total 117 LF of which permanent stream impacts total 60 LF as a result of proposed road fill and 21 LF of permanent, no loss impacts due to rip rap along the stream. The remaining proposed temporary stream impacts of 36 LF are a result of dewatering for sewer line installation. Proposed permanent impacts to riparian buffers include 3,033 sf (previously 3,469 sf) in Zone 1 and 4,092 sf in Zone �_orinzh Village Nrojecz Nage 2 of 3 2 for sewer line installation and stormwater conveyance. Previously approved wetland impacts associated with the construction of the stormwater pond total 0.07 acre. The total overall wetland impacts (previous and proposed) total 0.38 acre. Mitigation Permanent proposed stream impacts are less than 150 LF; therefore, no stream mitigation is proposed. Permanent proposed wetland impacts total 0.27 acre; therefore, mitigation is proposed for those impacts with credits purchased from Cloud & Banner Nutrient & Buffer Mitigation Bank (see attached letter). NC Wetland Assessment Method (NCWAM) forms were completed for Wetlands WA and two locations in Wetland WF. Wetland WA scored a HIGH rating, while both locations in Wetland WF scored a LOW rating. Wetland mitigation for impacts to Wetland WF and the permanent utility easement in Wetland WA are proposed at a 1:1 ratio totaling 0.15 credit. Mitigation for the remaining 0.12 acre of impacts is proposed at a 2:1 ratio totaling 0.24 credit. Total wetland credits to be purchased totals 0.39 unit. Mitigation for Zone 2 impacts of 1,961 sf (1,307 sf at 1.5:1 ratio) will also utilize the same private mitigation bank. No other impacts are proposed that would require mitigation.
