Reference the Department of the Army permit issued to the North Carolina Turnpike Authority
on February 5, 2009, subsequently modified on August 12, 2009, to authorize the discharge of fill
material into waters of the United States, for construction of the Triangle Parkway toll facility (TIP U-
4763B), from NC 540 to I-40, in northwestern Wake County and southern Durham County, North
Carolina. Reference also your December 21, 2009 letter, requesting to modify the permit to reflect the
final design completed by the design-build team for this project.
The final design results in relatively minor changes in impacts to streams and wetlands, some
I reductions and some increases, with a net increase of 0.01 acre of wetlands and 269 linear feet of stream.
I The increased impacts. are necessary because of several factors related to the final design, including
required bank stabilization, construction sequencing changes, future lane widening, modified grades,
and modified ramp curvature to meet design speed.
We have reviewed the requested modifications, and determined that they are appropriate and
reasonable, and no public notice is required for these modifications. Therefore, the permit is hereby
modified to include the changes listed and shown in the modified drawings in the December 21, 2009
modification request, for net permanent wetland impacts of 0.01 acre (no net change in 404 wetland
impacts), net permanent stream impacts of 269 linear feet, and net temporary stream impacts of -231
linear feet. Total impacts will now be 1.71 acres of permanent impacts to 404 wetlands, 0.07 acre of
permanent impact to an isolated wetland not regulated under Section 404, 3,974 linear feet of permanent
impact to streams with more than minimal aquatic function, 3,611 linear feet of permanent impact to
streams with only minimal aquatic function, 0.19 acre of temporary impact to wetlands, and 492 linear
feet of temporary impact to streams.

There is no change to mitigable impacts to 404 wetlands, and an increase of 177 linear
feet of impacts to streams requiring mitigation; therefore, special condition o) is modified as
follows:
o) NCTA will mitigate for 3,974 linear feet of unavoidable permanent impacts to
warm water streams with more than minimal function, and the 1.71 acres of impacts to 404
wetlands, through compensatory mitigation provided by the Ecosystem Enhancement Program
(EEP), pursuant to the EEP Memorandum of Agreement (MOA) between the State of North
Carolina and the US Army Corps of Engineers signed on July 22, 2003. The EEP will provide a
total of 7,948 linear feet of restoration equivalent warm water stream channel, and 3.11 acres of
restoration equivalent riparian wetlands (1.40 acres at 2:1, 0.31 acre at 1:1), in the Cape Fear
River basin (Cataloging Unit 0303002). NCTA shall certify that sufficient funds have been
provided to EEP to complete the required mitigation, pursuant to Paragraph V. of the MOA.
