This office has reviewed the referenced document. The Division of Water Quality (DWQ) is responsible for the issuance of the Section 401 Water Quality Certification for activities that impact Waters of the U.S., including wetlands. It is our understanding that the preferred alternative, as presented in the FONSI, will result in anticipated impacts to 0.26 acres of jurisdictional wetlands and 415 linear feet of streams. The DWQ offers the following comments based on review of the aforementioned document: A) At this time, the DWQ concurs with the Finding of No Significant Impact. The proposed impacts are not of a magnitude and nature to preclude the construction of the project. B) While the DWQ agrees that placement of such devices in wetlands in sometimes necessary, any devices placed in wetlands will need to be included in the 401 Water Quality Certification application, and approved by the NCDWQ. Failure by DOT to gain the necessary approvals may result in DOT not being in compliance with the 401 Water Quality Certification. C) Prior to an issuance of the 401 Water Quality Certification, the NCDOT is respectfully reminded that they will need to demonstrate the avoidance and minimization of impacts to wetlands (and streams) to the maximum extent practical. Should the impacts to jurisdictional wetlands exceed 1.0 acres, mitigation may be required in accordance with Environmental Management Commission's Wetland Rules { 15A NCAC 2H.0506 (h)(2) ). Based on the impacts described in the document, wetland mitigation will be required for this project. D) In accordance with the Environmental Management Commission Wetlands Rules { 15A NCAC 2H.0506(b)(6) ), mitigation will be required for impacts of greater than 150 linear feet to any single perennial stream. In the event that mitigation is required, the mitigation plan should be designed to replace appropriate lost functions and values. In accordance with the Environmental Management Commission's Rules 115A NCAC 2H.0506 (h)(3) ), the NC Ecosystem Enhancement Program may be available for use as stream mitigation. E) Placement of culverts and other structures in waters, streams, and wetlands must be placed below the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches, and 20 percent of the culvert diameter for culverts having a diameter less than 48 inches, to allow low flow passage of water and aquatic life. Design and placement of culverts and other structures including temporary erosion control measures shall not be conducted in a manner that may result in dis-equilibrium of wetlands or stream beds or banks, adjacent to or upstream and down stream of the above structures. The applicant is required to provide evidence that the equilibrium shall be maintained if requested in writing by DWQ. `JCDENfi N. C. G) Borrow/waste areas should avoid wetlands to the maximum extent practicable. Impacts to wetlands in borrow/waste areas could precipitate compensatory mitigation. The impacts to wetlands and streams that may occur from a borrow or waste site are impacts resultant from the road project, and such, are part of the impacts for the project. Any such impacts will require a 401 Water Quality Certification and any corresponding mitigation. While DOT may task the contractor with acquiring all appropriate permits, the contractors are agents for DOT, and DOT remains the responsible party for ensuring compliance with federal, state, and local laws and regulations. H) Future documentation should continue to include an itemized listing of the proposed wetland and stream impacts with corresponding mapping. An analysis of cumulative and secondary impacts anticipated as a result of this project is required. The type and detail of analysis should conform to the NC Division of Water Quality Policy on the assessment of secondary and cumulative impacts dated April 10, 2004. J) Based on the information presented in the document, the magnitude of impacts to wetlands and streams will likely require an Nationwide Permit application to the Corps of Engineers and corresponding 401 Water Quality Certification. Please be advised that a 401 Water Quality Certification requires satisfactory protection of water quality to ensure that water quality standards are met and no wetland or stream uses are lost. Final permit authorization will require the submittal of a formal application by the NCDOT and written concurrence from the NCDWQ. Please be aware that any approval will be contingent on appropriate avoidance and minimization of wetland and stream impacts to the maximum extent practical, the development of an acceptable stormwater management plan, and the inclusion of appropriate mitigation plans where appropriate. This proposal is a preliminary description of the mitigation plan and is subject to revision based on roadway design and agency comments. EXISTING CONDITIONS: Within the western quadrants of the roadway project, Charles Branch flows for approximately 500 feet in a southerly direction, crossin?? under Smith Avenue. Charles Branch then turns easterly and flows under US 17 Business. Charles Branch is approximately 15 feet wide. Emergent marsh vegetation is established along and within both banks. The right bank grades abruptly to the adjacent access road fill. The left bank grades gradually to a shrub scrub wetland and then to regularly maintained uplands adjacent to US 17 Business fill slopes. An Unnamed Tributary to Charles Branch flows parallel to Smith Avenue in an easterly direction for approximately 230 feet before crossing under an access road near its confluence with Charles Branch. The UT is approximately 6 feet wide. Emergent marsh vegetation is established along and within both banks. The right bank grades abruptly to a paved parking lot. The left bank grades abruptly to regularly maintained uplands adjacent to Smith Avenue fill slopes. Current drainage from adjacent development in the southeastern quadrant of the project flows into a collection box near -Y- STA 16 -70 and then discharges into Charles Branch. PROPOSED CONDITIONS: On site mitigation is proposed for two areas within the western quadrants of the roadway project. Area 1 is located along Charles Branch and to the west of US 17 Business. Wetland mitigation is proposed by grading the uplands and shrub scrub wetland to emergent marsh elevations. Target elevations will be determined by spot elevations in the existing marsh community within the banks of Charles Branch. The area will be planted with appropriate emergent wetland species. Drainage from southeastern quadrant of the project will be redirected to the western quadrant and allowed to sheet flow across the wetland mitigation area. Stream mitigation is proposed by removing the existing culvert in Charles Branch at Smith Avenue and restoring the appropriate channel dimensions. The banks will be matted with coir fiber matting and revegetated with appropriate species. Area 2 is located along the UT to Charles Branch to the south of Smith Avenue. Wetland mitigation is proposed by grading the uplands and the access road to emergent marsh elevations. Target elevations will be determined by spot elevations in the existing marsh community within the banks of the UT to Charles Branch. The area will be planted with appropriate emergent wetland species. Drainage from southwestern quadrant of the project will be discharged south of Smith Avenue and allowed to sheet flow across the wetland mitigation area. Stream mitigation is proposed by removing the existing culvert in the UT to Charles Branch at the access road and restoring the appropriate channel dimensions. It was noted that curb and gutter was eliminated as much as possible through out the project length. The following items were discussed: Sheet 4: NCDOT needs to verify if there is a wetland located right of station 25+50 -L-. A new building has been constructed in this area, possibly impacting all or part of the wetland. NCDOT noted that their design strategy is to provide as many storm water outfalls as possible in an effort to minimize concentrating the storm water runoff. I" Sheet 5: NCDOT is proposing to replace the existing 2 @ 8 foot 2 inch by 5 foot 9 inch corrugated steel pipe arches on Woodward Branch with an estimated 2 @ 12 foot by 6 foot reinforced concrete box culvert buried a foot. NCDOT will investigate providing wetland mitigation by regrading the area upstream of the new culvert on Woodward Branch down to the natural ground elevation from left of station 33+00 -L- to 35+00-L-. NCDOT will also investigate providing wetland mitigation on the property located downstream of the new culvert on Woodward Branch from right of station 34+00 -L- to 3 5+00 -L-. NCDOT will investigate piping the catch basin at station 16+00 -Y- (US 17 BUS.) to station 17+00 -Y- to avoid outleting it directly into the wetland. NCDOT will investigate if any of the drainage on the south east side of US 17 Bus. From station 16+00 -Y- to 19+00 -Y- can be drained to the other side of the road instead of directly into Woodward Branch. It was noted that due to elevation constraints that this probably was not possible. Sheet 6: NCDOT discussed the impact of the project on the wet detention pond located around station 53+00 -L-. NCDOT had originally planned on relocating the pond to the south side of the road. Hydraulics noted that the NCDOT Right of Way Department had discussed this option with the Attorney General's Office and determined that we could not purchase or condemn land from a third party for a replacement pond. Hydraulics then noted another option was to rebuild the pond on the original property owner's land on the north side of the road. Two locations on the north side were investigated. One location was to the west of the existing pond left of station 50+00 -L- on commercial property of the Shallotte Crossings development. It was determined that right of way cost associated with this location would be enormous. The other location would be just north and east of the existing pond on a designated retention pond easment between the proposed roadway and the Shallotte Crossings development. In order to rebuild the pond in this location approximately 850 feet of stream (Unnamed Tributary to Sharon Branch) would have to be piped around the new pond. The third option discussed was to revise the Roadway alignment to the south of the pond in order to avoid the pond. This option required a reduction in the design speed of the proposed road from 40 mph to 35 mph. The Roadway Design Unit noted that although this option was not preferred that it would be an acceptable design for the project. It was estimated that this option would impact approximately 200 feet of stream (Unnamed -0 Tributary to Sharon Branch). It was not known if additional wetland impacts would be incurred due to the new alignment. A site visit will be required to determine if there are additional wetlands located where the new alignment is proposed. After discussing the options, the team members agreed that revising the roadway alignment to the south of the pond in order to avoid relocating the pond would be the best option pending the investigation of wetlands in this area. Sheet 7: Hydraulics will use a grass swale along the right side of the road from approximately station 57+00 -L- to station 61+00 -L-. Hydraulics may have to pipe the storm drainage at station 64+00 -L- and 62+00 -L- back to station 60+00 -L- in order to avoid ditching through the wetlands right of station 62+00 -L-. Other comments: NCDCM had previously noted that there are no Areas of Environmental Concern (AFC's) located in the project area. They noted that the proposed project w1111 not require a CAMA Permit but will be processed by the Division of Coastal Management through concurrence with a Consistency Determination to be submitted by the DOT as part of any request for a federal permit. NCDCM will double check to make sure that this is still the case. Post meeting Activities DCM has confirmed that no AECs will be impacted in the project area. The project will not require a CAMA permit but will be processed by DCM through concurrence with a consistency determination. I rkJ .Q STORMWATER MANAGEMENT PLAN U-3462, WBS No.: 93453.1.1 Date:8-01-07 Brunswick County Hydraulics Project Manager: Andrew Nottingham, PE ROADWAY DESCRIPTION The project involves the widening and extension of SR 1357 (Smith Ave) in Shallotte. The project begins on Smith Ave. just west of the US 17Bus/NC 130 intersection and extends Smith Ave. from this intersection in a eastward direction for approximately 0.87 miles on new location and ends at NC 130 approximately 0.4 miles east of US 1713us. The overall length of the project is 1.23 miles. The proposed typical section varies along the project and generally consists of a 4-lane roadway section. Curb and gutter is used in the vicinity of the intersection of existing US 17Bus/NC 130 and shoulder section is used on the rest of the project. ENVIRONMENTAL DESCRIPTION The project is located in the Lumber River Basin in the Coastal Physiographic Province. There is one major stream crossing (Charles Branch) on this project, located on SR 1357 (Smith Ave.), approximately two hundred feet west of US 17Bus/NC 130. In addition tc this crossing, there are two other areas of noted concern. A tributary to Charles Branch paralleling SR 1357 (Smith Ave.) on the west side and a tributary to Sharron Branch behind the Home Depot approximately 0.30 miles west of the project's eastern terminus. Charles Branch is classified as Class C, Sw, and HQW waters. Sharron Branch is classified as SC and HQW waters. The existing stream crossing at Charles Branch will be replaced with a new RCBC on new location to the west of existing. The existing 6' x 5' culvert on US 1713us will also be extended upstream. A 72" rcp, buried 1.0 foot, on new location will be used to convey the tributary of Sharron Branch, located southeast of the detention pond for Home Depot. Approximately 380 feet of existing stream will be impacted due to the project. Seven wetland sites will be impacted. Approximately 0.15 acres of wetlands will be impacted due to this project. BEST MANAGEMENT PRACTICES AND MAJOR STRUCTURES Best Management Practices (BMPs) and measures used on the project are an attempt to reduce the stormwater impacts to the receiving streams due to erosion and runoff. Grassed swales were used to treat stormwater runoff prior to entering the streams. The inverts of all new culverts on jurisdictional streams or wetlands will be buried 20% of the pipe diameter up to 1 foot deep. There is one major stream crossings consisting of a new reinforced concrete box culvert and one major stream crossing consisting of a reinforced concrete box culvert extension. NCDOT asked for anv additional General comments from the team members and participants. i y Charles Branch Wetland and Stream Site Preliminary Mitigation Plan U-3462 Extension of SR 1537 Brunswick County August 22, 2007 The North Carolina Department of Transportation (NCDOT) proposes onsite wetland and stream mitigation for U-362 at the intersection ol'US 17 Business and Smith Avenue (SR 1537) in the western quadrants of the roadway project. This proposal is a preliminary description of the mitigation plan and is subject to revision based on roadway design and agency comments. EXISTING CONDITIONS: Within the western quadrants of the roadway project. Charles Branch flows for approximately 500 feet in a southerly direction, crossing under Smith Avenue. Charles Branch then tunes easterly and flows under US 17 Business. Charles Branch is approximately 15 feet wide. Emergent marsh vegetation is established along and within both banks. The right bank Vgrades abruptly to the adjacent access road till. The left bank grades gradually to a shrub scrub wetland and then to regularly maintained uplands adjacent to US 17 Business till slopes. An Unnamed Tributary to Charles Branch flows parallel to Smith Avenue in an easterly direction for approximately 230 feet before crossing under an access road near its confluence with Charles Branch. The UT is approximately 6 feet wide. Emergent marsh vegetation is established along) and within both banks. The right bank grades abruptly to a paved parking lot. The left bank grades abruptly to regularly maintained uplands adjacent to Smith Avenue fill slopes. Current drainage from adjacent development in the southeastern quadrant of the project flows into a collection box near -Y- STA 16 1 70 and then discharges into Charles Branch. PROPOSED CONDITIONS: On site mitigation is proposed for two areas within the wester quadrants of the roadway project. Area I is located alone? Charles Branch and to the west of US 17 Business. Wetland mitigation is proposed by grading the uplands and shrub scrub wetland to emergent marsh elevations. Target elevations will be determined by spot elevations in the existing marsh community within the banks ofCharles Branch. The area will be planted with appropriate enler-cnt wetland species, Drainage from southeastern quadrant of the project will be redirected to the western quadrant and allowed to sheet flow across the wetland mitigation area. Stream mitigation is proposed by removing the existing culvert in Charles Branch at Smith Avenue and restoring the appropriate channel dimensions. The banks will be matted xvith coir fiber matting and revci,etated with appropriate species. Area 2 is located along the UT to Charles Branch to the south of Smith Avenue. Wetland mitigation is proposed by "rading the uplands and the access road to emergent marsh elevations. Target elevations will be determined by spot elevations in the existing marsh community within the banks of the UT to Charles Branch. The area will be planted with appropriate emergent wetland species. Drainage from southwestern quadrant of the project will be discharged south of Smith Avenue and allowed to sheet flow across the wetland mitigation area. Stream mitigation is proposed by removing the existing culvert in the UT to Charles Branch at the access road and restoring the appropriate channel dimensions.
