APPROVAL of 401 Water Quality Certification with Additional Condition
Dear Mr. Wilton:
You have our approval, in accordance with the attached conditions, to place fill in 0.59 acre of non-vegetated wetlands in order
to repair a wooden bulkhead, reconstruct eleven wooden groins and place riprap 5' waterward of the existing and proposed bulkhead at
370 Harbinger Ridge Road in Currituck County, as described in your application received by the Division of Water Quality on September
10, 2003. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number
3400, which can be downloaded from our web site at http:Hh2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your
CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply
Watershed and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless
otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional
conditions listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401
Certification has been completed;
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days
of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina
General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

Site Descri ion
The applicant, Wilko Development, LLC, is the contract purchaser and potential
developer of seven lots totaling 45 acres in Currituck County. The lots are located at 370
Harbinger Ridge Road in Harbinger, just east of Owens Beach Road Extended adjacent to the
Albemarle Sound. To access the site, turn off US Highway 158 onto Edgewater Road (SR
1104) and travel 4/10 mile to Harbinger Ridge Road (SR 1103). Turn left, then immediately
right onto Owens Beach Road (SR 1408) and travel 4/10 mile. Turn left onto a farm field path
located 100' from the driveway at 205 Owens Beach Road and follow the 2/10 mile long path.
The subject parcel lies beyond the open iron gate, south and east of the chain link fencing.
Elevation of the 45 acre site ranges 6'-10' above mean sea level. Vegetation noted
growing within the site includes pine, oak, gum, black cherry, American holly, cedar,
dogwood, apple, sassafras, wax myrtle, and various volunteer grasses. Aerial photos taken in
October 1995 indicate that approximately 1,425 linear feet of bulkhead in good condition
protected the shoreline. Several groins were in place and extended up to 40' waterward of the
shoreline. CAMA permits authorizing the construction of those structures were not found
during a search of NC DCM's records. Storms and day to day erosion have affected the
structures such that the groins no longer function and long segments of bulkhead are missing.
The longest segment of functioning bulkhead (320 linear feet) was noted in the center of the
shoreline. At the east and west ends of the property respectively, 86' and 165' long sections of
intact bulkhead were noted. The east segment connects to an existing wood bulkhead whereas
the western end ties into an existing concrete wall. Other structures noted on-site were a shed,
horse barn, and a single-family residence located 38' landward of the 6' high erosion
escarpment.
The waters of the Albemarle Sound in the vicinity of the project are classified as SB
(swimming) by the NC Environmental Management Commission. These waters are classified
as Coastal Fishing Waters by the NC Marine Fisheries Commission and as Estuarine Waters
and Public Trust Waters by the NC Coastal Resources Commission. Contour of the bottom in
the project area (out to 44' in the sound) measures .5'-1.7' below NWL. The presence of
submerged aquatic vegetation was not noted in the vicinity of the project. Review of available
information suggests that there are no known archeological sites or geological formations
associated with the applicant's property.
The applicant proposes to:
. Construct five segments of replacement wood bulkhead totaling 809 linear feet within the
alignment of the original bulkhead. The replacement bulkhead is proposed a maximum
distance of 44' waterward of NWL and an average distance of 23'.

• Repair 606 linear feet of existing bulkhead by replacing tiebacks, installing new
bulkhead caps, and adding backfill in some areas with minimal subsidence.
• Place concrete riprap a maximum distance of 5' waterward of the 809 linear feet of
replacement bulkhead and 606 linear feet of existing bulkhead.
• Install eleven (11) wood groins a maximum distance of 25' waterward of NWL along the
1,416 linear feet of shoreline.
Anticipated Impacts
The construction of 809' of replacement bulkhead and the placement of 3,350 cubic
yards of sand backfill to a depth of 61 inches will result in the filling of 18,607
square feet of shallow water habitat.
• The placement of 3,500 cubic yards of sand material between the NWL and the
erosion escarpment (average distance 22') will result in the disturbance of 17,798
square feet of uplands.
The placement of a 5' wide section of concrete riprap immediately waterward of
1,416 linear feet of wooden bulkhead will result in the filling of 7,080 square feet
of shallow water habitat.
• The stabilization of 606 linear feet of severely eroded shoreline and the construction
of eleven 25' long groins should reduce the near shore (0'-60' out) siltation
observed along this shoreline during periods of strong off-shore winds.

This letter is accompanying a CAMA Major Permit Application package with plats and cross
sections for Wilko Development, LLC to reconstruct dilapidated bulkhead, point to point, on
soundfront property they are purchasing in Harbinger on the Albemarle Sound, Currituck
County, North Carolina.
Wilko Development, LLC is proposing to reconstruct 1,416 linear feet of bulkhead along the
existing bulkhead alignment on the 45 acre parcel they are currently purchasing, just east of
Owens Beach Road Extension. Portions of the existing bulkhead remain intact and only require
minor maintenance repair behind the bulkhead at this time, however, this application is
requesting to reconstruct the entire bulkhead along the existing alignment. The reconstructed
bulkhead will continue from point to point, beginning at the east end from David Griggs existing
bulkhead, and continuing along the existing bulkhead alignment, to the west end, to Terry
Lynn's cement wall. There are no SAV's, Section "404" wetlands or coastal vegetation located
within the proposed bulkhead or backfill area.
There are four sections in the existing bulkhead alignment where hurricane and severe storm
damage has taken place over approximately three years. Details of each section of damaged
bulkhead is in table format within the body of the attached project narrative and attached cross
sections (Sheets 3, 4 and 5).

The purpose of the proposed activity is to reconstruct the existing 1,416 linear foot
bulkhead, point to point, which has dilapidated in four areas (see sheet 2 of 5: (A), (B),(C
& D), (E)) along the existing bulkhead alignment, from several hurricane and storm
events. Remnant bulkhead, tiebacks and filter cloth are present in four areas, ((A), (B),
(C & D), (E)) along the existing alignment where reconstruction of bulkhead is proposed
and sever escarpment exists. These four breaks in the bulkhead, left the shoreline
venerable to storm erosion. The remaining four areas of the bulkhead (606 feet) remain
in good condition, excluding minor backfill repair in some areas averaging two feet wide
(see sheet 2 of 5). Predominant southwest winds make this area along the Albemarle
Sound a high wave energy area, therefore, without shoreline stabilization the shoreline is
venerable to continual erosion. Personal observation from neighbors, broken areas in the
bulkhead has eroded the shoreline 5+ feet in the past 12 months. Reconstructed bulkhead
will tie back into the adjacent landowners existing shoreline stabilization. Currently the
east end of the remnant bulkhead is only missing a five-foot section of bulkhead wall
boards. The west end of the existing bulkhead remains intact and in good condition and
ties into the adjacent landowners (Terry Lynn) cement wall, with a 31 foot return. Once
the reconstructed bulkhead is in place existing rip rap (606'x 5'base) taken from in front
of the existing bulkhead will be placed in front of the newly constructed bulkhead to
continue rip rap alignment with the proposed rip rap (809'x 5'base) to a total rip rap
length of 1,416 linear feet.
Four sections of bulkhead, totaling 606 linear feet, are currently intact and require minor
maintenance repair behind the bulkhead, however this project includes the entire
bulkhead to be reconstructed. Proposed bulkhead to be reconstructed (1,416 linear feet);
groin reconstruction (Eleven 25'foot wooden groins, see sheet 5 of 5) and backfill from
the existing alignment to the escarpment (includes 6,140 s.f of open water fill). Rip rap
is proposed five feet wide, in front of the four sections of remnant bulkhead once
reconstructed. The existing rip rap (606'(L) x 3'(H) x 5'(W)) in front of the intact
bulkhead will be placed in front of the reconstructed bulkhead. Once all rip rap is in
place, rip rap height will be approximately one foot above the NWL. Rip rap is proposed
in front of the four sections of reconstructed dilapidated bulkhead, since the existing
intact areas of bulkhead are presently armored with rip rap (606'), and may be a factor to
why these areas of bulkhead remain intact and in good condition.
Existing structures on the property include a two-story single-family residential dwelling,
three bar-b-q pits, storage shed, five stall horse barn with storage area and fenced in area.
Predominant southwest winds make this area along the Albemarle Sound a high wave
energy area. Therefore, submerged aquatic vegetation (SAV's) does not normally exist
in these high-energy areas, which usually support aquatic invertebrate and vertebrae:

species. It is to the findings of the field biologist during site visits, aquatic life is not
reported in this project area.
There is no submerged aquatic vegetation (SAV's) within the project area or outside the
project area. There are no coastal or Section "404" wetlands present within this 45 acre
tract or within the project area or outside the project area. The eroded shoreline has a
distinct escarpment averaging six feet (6') in depth (measurements taken every 15 feet
along the escarpment). The eroding shoreline continues to erode with every strong
southwest wind. During the pre-application meeting with the DCM field representative
on August 7t", we observed the strong west wind causing a turbidity plume, from the
existing backfill eroding into the open waters. Bulkhead debris is scattered throughout
the entire length of the shoreline and in the water.
Groins to be reconstructed (11) will not exceed 25 feet waterward of the NWL and height
shall not exceed 1 foot above NWL. Groins are proposed to be reconstructed to continue
to hold existing sand in place in this high wave energy area along the shoreline.
AEC environmental scientist on August 15th, 21 st, 22nd and 24th took the following
measurements.

All field measurements taken during an actual normal wind tide (NWL). Water depths
were taken in five-foot increments from the NWL to the bulkhead alignment. Transects
were taken 25 feet apart in Section (B) and 10 feet apart in the remaining (C)(D)&(E)
Sections. Escarpment measurements were taken every 15 feet or less.

adequate number of quality copies are provided by
