provide access to a single-family residential lot.

9. PROJECT DESCRIPTION
The project site is located at Lot 5 Oak Island Drive, adjacent to Piney Point Creek, in the Town of Oak
Island, in Brunswick County. The tract is approximately .53 acre in size, measuring 100 feet in width
and approximately 135 feet in depth from Oak Island Drive. The lot averages 5' - 8' in elevation. The
lot is wooded, including Oak, Hickory, Sweet Gum, Loblolly Pine, Wax Myrtles and an occasional Red
Cedar. Along the shoreline there is a border of coastal wetlands, consisting primarily of Smooth
Cordgrass (Spartina alterniflora). High coastal marsh plant species including Black Needle Rush Juncus
roemarianus) and Three Square Sci us spp.) complete the marsh transition to the highground area of
the lot. Above tidal influence, there is a "404 type" wetland drain that bisects the lot and conveys
stormwater from an existing culvert under Oak Island Dr. to the marsh. At some point in time, the
drainage flow from the culvert has been channelized in a small ditch along the eastern property line. The
wetlands have been delineated, and the delineation has been approved by the US Army Corps of
Engineers.
The waters of Piney Point Creek are classified SA, by the NC Division of Water Quality. The waters
adjacent to the project area are designated as Primary Nursery Area (PNA), by the NC Division of
Marine Fisheries. They are CLOSED to the harvesting of shellfish.
The applicant is proposing to construct a single family residence on this lot. In order to do so, he is
proposing to fill 790 square feet (.018 acre) of the wetland drain area on the lot to allow for driveway
access to the building site. The applicant has relocated the proposed driveway crossing to the southeast
corner of the property in an effort to reduce wetland impacts. The applicant proposes to install silt
fencing to control sedimentation on both sides of the wetland fill area. Once the driveway is completed,
the applicant proposes to clear a building area on the lot (1,960 sgft.) and construct a single-family
residence, 63 feet long and 30 feet wide (1,890 sqft.).
10. ANTICIPATED IMPACTS
The proposal would cause the loss of a 790 square feet of Section 404 wetlands (Clean Water Act). The
application states that an additional 1,960 square feet of high ground will be graded and filled during the
construction and landscaping of the residence. It is unlikely that construction of a 1,890 square feet
residential structure can be accomplished within the proposed 1,960 square feet disturbed area. I would
anticipate the disturbed area needed for construction to be at least twice the proposed area, with
additional disturbance for landscaping at the completion of construction.

INTRODUCTION
The applicant proposes to fill approximately 0.018 acre (790 ftz) of freshwater wetlands to provide access to
a single-family residence that will be 1,890 ftz in size. Although the wetland impact will occur outside of the
Area of Environmental Concern (AEC), a portion of the house footprint is within 75' of Mean High Water,
therefore, a CAMA Major Permit is required.
EXISTING CONDITIONS
The project site consists of a 0.53-acre lot that is bound by Oak Island Drive to the south and Piney Point
Creek (a tributary of the Elizabeth River) to the north. The CAMA Land Use Plan for Brunswick County
classifies this area as Community and Conservation Class (all wetlands are within the Conservation Class).
The parcel is zoned residential by Brunswick County. Existing high ground elevations are 5' to 8' MHW.
The lot is currently undeveloped and contains a wetland finger that runs from the northern part of the lot
down through the middle of the property. Vegetation within uplands consists of red cedar (Juniperus
virginiana), sweetgum (Liguidambar styraciflua), and loblolly pine (Pinus taeda). Freshwater wetlands
contain black gum (Nyssa sylvatica), wax myrtle (1lfyrica cerifera), and Virginia chain fern (Woodwardia
virginica). Coastal wetlands vegetation consists of wax myrtle, Scirpus spp., and smooth cordgrass
(Spartina alterniflora).
POTENTIAL ENVIRONMENTAL IMPACTS AND DESIGN CONSIDERATIONS
Figure 4 of the application package depicts proposed site activities. Based upon initial comments from the
DCM Wilmington office (see correspondence dated May 19, 2003 from Janet Russell), the proposed access
driveway has been relocated toward the southeastern comer of the property in an effort to reduce impacts to
site wetlands. Existing utility lines and a drainage easement restrict the access drive from being located
immediately adjacent to the eastern boundary of the lot. Therefore, approximately 790 sf of the upper
portion of the existing wetland will be impacted by proposed activities. The revised square footage includes
the surface area of the driveway itself and adjacent 2:1 grassed side slopes. This portion of the wetland is
relatively shallow (differing only by 0.5 to 1.0 ft in elevation from adjacent uplands. Therefore, grassed side
slopes are sufficient stabilization for the driveway. Wetland impacts have been reduced as much as possible
during the site design process. The proposed driveway is only 20' wide, which is the minimum width needed
to provide adequate space for vehicles. Overall, the revised footprint is less segmental to existing wetlands
and will result in minimal impact to wetlands on the site.
Silt fences will be installed prior to any construction to minimize and contain sediment material near
wetlands. All construction activities will occur landward of silt fences. Once the driveway is complete and
access to the northeastern section of the lot is available, the applicant will begin constructing the house. The
proposed house footprint is 1,890 ft2 (30' x 63').
