After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3402, which may be viewed on our website at http://h2o.enr.state.nc.us/ncwetlands. This certification allows you to use Nationwide Permit Number 18 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Page 12 of 12 The applicant for this 404 permit owns twenty acres of land in Durants Neck section of Perquimans County in eastern North Carolina. Of this acreage, eight acres have been in crop production, one acre is prime, bulkheaded waterfront land, approximately 4 acres are forest and the remaining seven acres are swamp forests and wetlands. Unfortunately a small portion of the wetlands divides the property and thereby limiting the accessibility from the soundfront toe the proposed pasture area and barn. It is the desire of the applicant to have a road constructed to link the farm areas with the residential areas to maximize efficiency of the farm. The utilization of Best Management Practices (BMP) will minimize impacts to the proposed sited. 1.) The total square foot area displaced by the road crossing will be the least amount possible while at the same time be constructed to safely accommodate farm equipment and personal vehicles. The amount of wetland affected by this construction will be less than one-tenth of an acre. 2.) The culvert installed under the road will be of sufficient diameter and length to handle all conceivable drainage problems. The applicant is aware that this area is in the flood plain and thus road components will be adjusted accordingly. 3.) The integrity of surrounding wetlands will be preserved using ACOE criteria BMP. a) Buffer strips to minimize sediment deposits from washing into the wetlands and ultimately the sound. b) Supervision by owner to insure minimal encroachment of large equipment on surrounding wetlands. c) Immediate planting of native wetland species along road edge to insure soil remains on the land and not in NC estuaries. d) The waterfront'acre is planted in centipede grass, a warm season grass which requires minimal fertilization and infrequent mowing resulting in less residue runoff. Watering is rarely necessary. intended to filter residues as well as provide and excellent 1 wildlife. Angora goats will be grazed on the pasture using a system of rotational grazing which is suppose to be more environmentally friendly. To compensate for the one-tenth acre loss of wetlands due to this construction, the owner proposes to enhance the efficacy of the existing wetlands on the same property. Presently the wetlands in question are in a state of abuse. The land has been in the present ownership for one year. Prior to this, the wetlands on this property had been used as a dumping ground for just about anything including many non-organic, non-degradable and impermeable objects like refrigerators, stoves, cars and old farming equipment. If these wetland are to serve the purpose that nature intended i.e. filter surface water run-off, abate flood waters and recharge aquifers some major clean-up is in order. As exists, this area certainly doesn't provide an acceptable wildlife habitat except to the most undesirables.
