APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Mr. and Mrs. Cerchione:
You have our approval, in accordance with the attached conditions, to place fill in 50 linear feet of perennial
streams in order to construct a road crossing to your property in Watauga County, as described in your
application received by the Division of Water Quality on June 23, 2003, and in additional correspondence
received July 14, 2003. After reviewing your application, we have determined that this fill is covered by General
Water Quality Certification Number 3404, which can be viewed on our web site at
http://h2o.enr.state.nc.us/ncwetlands. This Certification allows you to use Nationwide Permit Number 14 when it
is issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-
Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404
permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us in writing and you may be required to send us a new application for a
new certification. If the property is sold, the new owner must be given a copy of the Certification and approval
letter and is thereby responsible for complying with all conditions. If total wetland and/or stream fills for this
project (now or in the future) exceed one acre or 150 linear feet of perennial streams, compensatory mitigation
may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification, as well as the additional conditions listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work included
in the 401 Certification has been completed;
2. The culvert required for this project shall be installed in such a manner that downstream profiles are not
altered (i.e. the depth of the channel must not be reduced by a widening of the streambed). Existing stream
dimensions (including the pattern and profile) are to be maintained above and below locations of each
culvert. The culverts shall be designed and installed to allow for aquatic life movement as well as to prevent
head cutting of the streams. If any of the existing pipes are or become perched, the appropriate stream
grade shall be re-established or, if the pipes installed in a perched manner, the pipes shall be removed and
re-installed correctly.
The establishment of native, woody vegetation and other soft stream bank stabilization techniques must be
used where practicable instead of rip rap or other bank hardening methods; If rip-rap is necessary, it shall
not be placed in the stream bed, unless specifically approved by the Division of Water Quality.

unless you ask for a hearing.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property

Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide

DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmgide.html.

as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach

These comments are provided in accordance with the provisions of the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the North Carolina
Environmental Policy Act (G.S. 113A-1 through 113A-10; NCAC 25). The NCDOT
proposes to grade, drain, base and pave SRI 503. A 35' x 18" CMP will be replaced at
Station 37+90 with a 50' x 24 CMP. Channel relocation will impact a 73' section of
stream. The channel relocation will mimic existing conditions. Riprap impacts will be
minimized. Temporary dewatering will be required.
Based on our review of the submitted application and our knowledge of the area, we will
not object to project as proposed providing the following conditions•arelfmplemented:
1. Instream work and land disturbance within the 25-foot wide buffer zone are
prohibited during the brown and brook trout spawning season of October 15 through
April 15 to protect the eg_ ? and fry stages of trout from off-site sedimentation during
construction.
2. Culverts 48" or larger should be buried approximately 1' into the streambed.
Culverts less than 48 inches in diameter should be buried to a depth equal to or
greater than 20% their size to allow for aquatic life passage. These measurements
must be based on natural thalweg depths.
3. Riprap should be minimized and installed in a manner so as not to interfere with
aquatic life passage during low flow conditions.
4. If any concrete will be used, work must be accomplished so that wet concrete does
not contact stream water.

5. The new channel must be built in the dry and fully stabilized before turning the
stream into it. Naturally occurring vegetation on site should be stockpiled and used
for the new streambanks. If this is not possible, disturbed banks should be
revegetated with silky dogwood (Cornus amonum), silky willow (Salix sericea), tag
alder (A1nus serrulata), black willow (Salix nigra), and sycamore (Platanus
occidentalis) or other lower growing native species to provide long term bank
stability and stream shading. Note that silky dogwood, silky willow and black
willow can be planted as live stakes collected during the dormant growing season.
Cuttings should be randomly planted and done on 4 foot centers from the waters edge
to the top of the bank. Trees should be planted on 10-12 foot centers. Stream banks
in these areas should also be stabilized with matting or seeded with an approved
wetland seed mix or temporary crop of wheat or rye.

We are planning to install a culvert twenty (20) foot long and six (6) foot in diameter in the creek
that borders our property. The culvert will be buried one (1) foot deep into the creek bed and
riprap (placed over a landscape cloth) will be minimized and installed in accordance with DOT's
requirements so as to not interfere with aquatic life passage during low-flow conditions. All work
will be done in a manner that is designed to cause the least disturbance possible to the creek
during installation with the goal of leaving the creek as pristine as possible. (Keep in mind that
DOT has rechanneled the creek just below us from its original path for over 100 feet). No
concrete will be used and the stream bank will be stabilized as soon as the work is completed.
It is imperative the work proceed as soon as possible. DOT is in the process of widening and
paving Lawrence Greene Road and, in doing so, it will leave access to our property very
difficult, if not impossible. The new road will be three to four feet higher than our bridge (at
approximately four feet from the end of the bridge) making it virtually impossible for most
vehicles to use.
Both my husband and I have heart problems and need to be able to get into and out of our
property should an emergency arise. It is essential that an ambulance be able to do the same.
There is no other access to our property and no other way to gain entry.
This project has been approved by the U.S. Army Corps of Engineers, Wilmington District,
Action ID. 200321021 and by the North Carolina Wildlife Resources Commission in their letter
dated July 5, 2002 (both attached).

These comments are provided in accordance with the provisions of the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the North Carolina
Environmental Policy Act (G.S. 113A-1 through 113A-10; NCAC 25). The NCDOT
proposes to grade, drain, base and pave SR1503. A 35' x 18" CMP will be replaced at
Station 37+90 with a 50' x 24 CMP. Channel relocation will impact a 73' section of
stream. The channel relocation will mimic existing conditions. Riprap impacts will be
minimized. Temporary dewatering will be required.
Based on our review of the submitted application and our knowledge of the area, we will
not object to project as proposed providing the following conditions'arelmplemented:
1. Instream work and land disturbance within the 25-foot wide buffer zone are
prohibited during the brown and brook trout spawning season of October 15 through
April 15 to protect the eg_ ? and fry stages of trout from off-site sedimentation during
construction.
2. Culverts 48" or larger should be buried approximately 1' into the streambed.
Culverts less than 48 inches in diameter should be buried to a depth equal to or
greater than 20% their size to allow for aquatic life passage. These measurements
must be based on natural thalweg depths.
3. Riprap should be minimized and installed in a manner so as not to interfere with
aquatic life passage during low flow conditions.
4. If any concrete will be used, work must be accomplished so that wet concrete does
not contact stream water.

5. The new channel must be built in the dry and fully stabilized before turning the
stream into it. Naturally occurring vegetation on site should be stockpiled and used
for the new streambanks. If this is not possible, disturbed banks should be
revegetated with silky dogwood (Corpus amonum), silky willow (Salix sericea), tag
alder (Alnus serrulata), black willow (Salix nigra), and sycamore (Platanus
occidentalis) or other lower growing native species to provide long term bank
stability and stream shading. Note that silky dogwood, silky willow and black
willow can be planted as live stakes collected during the dormant growing season.
Cuttings should be randomly planted and done on 4 foot centers from the waters edge
to the top of the bank. Trees should be planted on 10-12 foot centers. Stream banks
in these areas should also be stabilized with matting or seeded with an approved
wetland,seed mix or temporary crop of wheat or rye.
