APPROVAL of 401 Water Quality Certification and AUTHORIZATION CERTIFICATE per the Neuse River Buffer
Protection Rules (15A NCAC 2B.0233) with ADDITIONAL CONDITIONS
Dear Mr. Montgomery:
You have our approval, in accordance with the attached conditions and those listed below, to place fill within or
otherwise impact 145 feet of streams and 7,000 square feet (ft2) of protected riparian buffers for the purpose of
constructing a road and to impact 26,100 square feet (ft) of protected riparian buffers for the purpose of installing a
sewer system within an existing, cleared utility easement at the subject property, as described within your application
dated June 18, 2003. After reviewing your application, we have decided that the impacts are covered by the N.C.
Division of Water Quality (DWQ) General Water Quality Certification Number(s) 3402 (GC3402). The Certification(s)
allows you to use Nationwide Permit(s) 39 when issued by the U.S Army Corps of Engineers (USACE). This letter shall
also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B
.0233. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before
you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-discharge, and water
supply regulations. Also, this approval will expire when the accompanying 404 permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application. If the property is sold, the new owner must
be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If
total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and any additional conditions listed below.
Conditions:
1. Sewer System
No trees or woody vegetation shall be removed from the protected riparian buffers associated with the installation of
the sewer system, unless otherwise approved by the DWQ. In addition, the project shall comply with 15A NCAC 2H
.0219(i)(2)(G) and all other State, Federal and local sewer system regulations.
2. Diffuse Flow
An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities through the
protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A
NCAC 2B.0233(5).

3. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any
subsequent modifications, the applicant is required to return the attached certificate of completion to the
401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
4. Water Quality Certification(s)
The proposed project must comply with all of the conditions of General Water Quality Certification(s) (GC) 3402.
Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or
civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the
Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or
CAMA permit.
If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts),
you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for
a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final
and binding unless you ask for a hearing.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts)
shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in
Articles 3 and 4 of G.S. 150B.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and the
Neuse riparian buffer protection rule as described within 15A NCAC 213 .0233. If you have any questions, please

2 agree. Seems to me that the minimization requirement is met by allowing
the impact within the existing cleared easement even if it is Zone 1.
Regarding the road crossing, if it is under threshold, let'er rip.

Dear Ms. Jones and Mr. Dorney:
On behalf of the Town of Wilson (applicant), we hereby request authorization from the
US Army Corps of Engineers (USACE) to use Nationwide Permit 39 for proposed
permanent impacts to a perennial stream resulting from a road crossing and Nationwide
Permit 12 for proposed temporary impacts to a wetland resulting from a sewer line. In
addition, we request written concurrence from the North Carolina Division of Water
Quality (NC-DWQ) that the project complies with the Neuse Buffer Rules and the 401
Water Quality Certifications associated with NWP 39 and NWP 12. A Pre-construction
Notification Application (PCN) is attached, as well as an agent authorization form.
The site is located in Wilson, North Carolina and is cast of Corbett Avenue (SR 1326),
and west of London Church Road (SR 1327), beginning approximately 3,000 feet south
of the intersection of Corbett Avenue and London Church Road County. Please refer to
the attached map (Figure 1) for the project's location on a USGS topographic quadrangle.
S&EC performed a wetland and Neuse Buffer evaluation of the site in December 2002.
Because S&EC believes features B and C are subject to the buffers within the athletic
complex boundaries, S&EC has not requested that NC-DWQ conduct a site visit to make
a buffer verification. No jurisdictional determination and no previous permits have been
obtained for this site.

The purpose of this project is to construct a public use athletic complex and park that will
facilitate recreation activities for area residents. Past impacts include 0.09 acre, of lot rill,
which will be used to facilitate the construction of soccer fields (see attached plan).
Please note that this impact was recently made under a Non-reporting Nationwide Pen-nit
39 during the grading of some adjacent areas. This area had been used as the "fairway"
of a Frisbee golf course, which subjected the area to considerable foot traffic and
essentially eliminated the presence of herbaceous vegetation. Proposed impacts will
result from construction of a road crossing to access the site and installation of a force
main to provide sewer service to the site (see impact maps).
The proposed road crossing will result in permanent impacts to 145 linear feet of
perennial stream channel and 7,000 square feet (0.16 acre) of Neuse Buffer. Two options
are possible for the location of the proposed force main: 1) the main could be installed in
Zone 1 of feature A, within an existing, regularly maintained utility easement along the
grassed right-of-way of Corbett Avenue (see Fig. 3); or 2) the main could be installed
outside of Zone 2, but within a mature, bottomland hardwood forest (see Fig. 4). At the
request of Mr. Bob Zarzecki, of NC-DWQ, we are providing descriptions of the two
options for the location of the proposed sewer line. The two options are described below.
Option 1
Under this option, the force main will be installed in an exiting grassed utility casement,
within the road right-of-way of Corbett Avenue, resulting in 26,100 square feet of impact
to Zone 1 of the buffer of feature "A" (see Fig. 3). It is important to note that this area is
currently vegetated by fescue and does not contain jurisdictional wetlands; thus, the
installation of the main would not result in the removal of any woody vegetation or
impact any wetlands. It should also be mentioned that feature "A" is a perennial stream
that was channelized in the distant past and now more closely resembles a straight
roadside ditch.
Option 2
Under this option, the force main will be installed outside of both Zones 1 and 2 of the
Neuse Buffer. However, a mature bottomland hardwood forest is located immediately
beyond the utility easement and right-of-way of Corbett Avenue (see Fig. 4). Locating
the main outside of the Neuse Buffer would result in the clearing of approximately
24,884 square feet of forested land to install the main and establish a maintenance
corridor. This location will also result in temporary impacts to 0.009 acre of bottomland
hardwood wetland.
S&EC believes option 1 is the best choice for the location of the proposed force
main, as it will ultimately result in the least amount of disturbance to existing
riparian vegetation and wetland areas. If NC-DWQ decides that locating the main in
Zone I is the more preferable of the two alternatives S&EC does not believe that
mitigation should be required for the resulting impacts because the proposed sewer

casement is currently an existing regularly maintained powerline easement. However, if
NC-DWQ determine, n-.tigation is necessary, the applicant proposes payment into tltc
NC-WRP. Because the Buffer impacts associated with the proposed road crossing
impact less than 1/3 acre and 150 linear feet of riparian buffer, S&EC believes buffos
mitigation for this impact should not be required.
The USACE's current policy requires applicants to avoid and minimize wetland and
stream channel impacts to the maximum extent practicable and may require
compensatory mitigation to offset unavoidable losses of waters of the US when impacts
exceed the thresholds for notification (0.10 acre) or if a discharge causes the loss of any
open waters. Because the proposed road crossing is aligned perpendicularly with the
channel, and because the only other permanent impact associated with the project
consists of 0.09 acre of wetland previously impacted under a Non-reporting Nationwide
39, S&EC believes mitigation should not be required by the USAGE for this project.
NC-DWQ's current policy requires mitigation for perennial stream impacts greater then
150 linear feet per project and wetland impacts greater than 1 acre per project. Because
the proposed project impacts are below these thresholds, S&EC believes that neither
stream nor wetland mitigation should be required by NC-DWQ.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,

This project consists of a public recreational facility. The project will involve the
construction of athletic fields and a parking area and the installation of a -utility line.
Conventional heavy equipment typical of such projects will be used.

athletic complex and park for public use by residents of the Town of Wilson.
IV. Prior Project History
If jurisdictional determinations and/or pennits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date pennits and

V1. Proposed Impacts to Waters of the United States/Waters of the State

wetlands, open water, and stream channels associated with the project. The applicant must also
provide justification for these impacts in Section V11 below. All proposed impacts, permanent
and temporary, must be listed herein, and must be clearly identifiable on an accotnpatlying site
plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a
delineation map, whether or not impacts are proposed to these systems. Wetland and stream

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
intbrtnation related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The applicant requested a wetland delineation prior to site plan development in order to avoid
wetlands and waters to the maximum extent practicable. The applicant is planning to construct a
road crossing of a perennial stream channel that separates Corbett Avenue from the property in
order to access the site. The proposed crossing will be aligned perpendicular to the channel in
order to minimize impact. The applicant would prefer utility location option 1 which is
described in detail in the attached cover letter. Under this option, a utility line required for the
development of the site would be installed within an existing grassed utility casement and road
right-of-way, in lone I of the NcuSe Buffers, rather than being located outside the Buffers,-in a
mature bottomland hardwood forest and wetland area. Because the proposed mad crossing-is
aligned perendicular to the channel, and because the applicant has devised an alternative

location for the proposed sewer line that will minimize impact to existing lJorest and wetlands,
S&EC believes the client has minimized project impacts to the maximum extent practicable. _
VI11. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in detennining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/stringidc.html.
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
N/A - Because the proposed road crossing is aligned perpendicularly with the channel, and
because the only other permanent impact associated with the project consists of 0.09 acre of
wetland previously impacted under a Non-reporting Nationwide 39, S&EC believes
mitigation should not be required by the USACE for this project. However, if tile USACE
detennines mitigation is necessary for this project, the applicant proposes payinent into the
NC Wetlands Restoration Program.

S&EC believes option 1 is the best choice for the location of the proposed force main, as it
will ultimately result in the least amount of disturbance to existing riparian vegetation and
wetland areas. If NC-DWQ decides that locating the main in Zone 1 is the more preferable of
the two alternatives S&EC does not believe that mitigation should be required for the resulting
impacts. However, if NC-DWQ detennines mitigation is necessary, the applicant proposes
