Toma 108 Richelieu Drive Cary, NC 27511 Subject Property: Toma Residence, 108 Richelieu Drive, Cary, NC 27511 UT to Swift Creek [03-04-02, 27-43-(1), WS-III (water supply) NSW (nutrient sensitive)] APPROVAL of Neuse River Riparian Buffer Protection Rules MINOR VARIANCE [15A NCAC 2B.0233(9)(b)] Dear Dr. Toma: You have our approval, in accordance with the conditions .listed below, to impact approximately 1,253 square feet (ft2 ) of Zone 2 of the protected buffers to construct additions to your existing home, pool, patio and retaining wall at the subject property as described within your variance request received by this office on June 3, 2003 including additional information provided on June 25, 2003 and dated June 20, 2003. This letter shall act as your Minor Variance approval as described within 15A NCAC 213 .0233(9)(b). In addition to this approval, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control regulations. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner(s) must be given a copy of this variance approval and are thereby responsible for complying with all conditions. For this approval to be valid, you must follow any conditions listed below. Conditions: 1. No Zone 1 Impacts No impacts (except for the proposed bio-retention area stormwater management facility and "exempt" uses as identified within 15A NCAC 2B .0233) shall occur to Zone 1 of the protected riparian buffers unless otherwise approved by the DWQ. No impervious surfaces shall be added to Zone 1, unless otherwise approved by the DWQ. 2. Buffer Mitigation (WRP) You are required to mitigate for impacts to the protected riparian buffers. The required area of mitigation to compensate for impacts to the protected riparian buffers is 1,880 square feet as required under this variance approval and 15A NCAC 213.0242. We understand that you wish to make a payment into the Riparian Buffer Restoration Fund administered by the NC Wetlands Restoration Program (WRP) to meet this mitigation requirement. This has been determined by the DWQ to be a suitable method to meet the mitigation requirement. In accordance with 15A NCAC 213 .0242, this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 213 .0233(9)(C). Until the WRP receives and clears your check (made payable to: DENR - Wetlands Restoration Program Office), no impacts specified in this variance approval shall occur. For accounting purposes, this variance approval authorizes payment into the Riparian Buffer Restoration Fund to compensate for 1,880 ft2 of required riparian buffer mitigation for impacts to 1,253 ft2 of protected riparian buffers; 03-04-02, 27-43-(1) river and subbasin." 3. The stormwater management plan must include plans and specifications for stormwater management facilities that are appropriate for surface waters classified as WS-III NSW and designed according to the most recent version of the NC DENR Stormwater Best Management Practices Manual. These facilities must be designed to treat the runoff from the entire project, unless otherwise explicitly approved by the Division of Water Quality. Also, the facilities (as approved by this Office) shall be constructed and operational, and the stormwater management plan (as approved by this Office) shall be implemented immediately following construction of the pool area. The structural stormwater practices as approved by this Office as well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. The stormwater management plan must include the bfo- retention area as depicted within your variance request. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Requests for appeals of this decision shall be made to the Office of Administrative Hearings. If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. This approval and its conditions are final and binding unless you ask for a hearing. The Division of Water Quality (DWQ) is required to prepare a "preliminary finding" /"finding of fact" as to whether the variance request meets the requirements of 15A NCAC 02B .0233(9)(a). The DWQ may attach conditions to a variance approval that support the purpose, spirit and intent of the riparian buffer protection program. Conditions usually include stormwater management and buffer mitigation. Additional information will be required before we can proceed with the review of your variance request. Therefore, unless additional information is provided as described below, we will have to move toward denial of your request per 15A NCAC 2B .0233 and will place this project on hold as incomplete until we receive this additional information. Additional Information Requested: 1. Buffer Mitigation - Buffer mitigation will most likely be required as a condition if you choose to proceed with either the Minor or Major Variance. If you choose to proceed with a variance, then please provide a buffer mitigation plan pursuant to 15A NCAC 0213.0242. 2. Proposed Addition - The proposed addition located on the northwest side of the house would encroach within Zone 1 of the protected buffers. This will require a Major Variance from the Rule. Please redesign to avoid this impact or contact this office if you wish to pursue a Major Variance. I've included the county topo and soils information, an aerial image, a survey of the property showing the creek and the proposed building addition footprint, and a sketch of the proposed swimming pool complex. The property is located at 108 Richelieu Drive in Regency Park in Cary. The house as it stands now is within 20 to 25 feet of the creek and the rear yard is cleared with a lawn sloping down to the creek where there is about a five foot "natural" area between the lawn and the creek. The floor elevation of the basement level of the house is approximately 12 feet above the creek bank. The homeowner wishes to add. onto the western side of the house - the proposed footprint is shown as a cross-hatched area on both the site plan and pool area sketch. It seems that realigning the section of the creek closest the house to eliminate the greater than 90' bend may make sense to protect from any future erosion of the steep bank closest the house. In its current flow stormwater runoff flows from the lawn into the creek with only a narrow natural area to slow the flow. We would propose grading the lawn area to create a detention basin that would act as a level spreader with perhaps a small orifice outlet.
