Project No. 01-5565 UT to Swift Creek [03-04-02, 27-43-5-(2), WS-III NSW (nutrient sensitive)] APPROVAL of 401 Water Quality Certification and AUTHORIZATION CERTIFICATE per the Neuse River Buffer Protection Rules (15A NCAC 2B .0233) with ADDITIONAL CONDITIONS Dear Mr. Congleton: You have our approval, in accordance with the attached conditions and those listed below, to place fill within or otherwise impact 85 feet of stream and 2,576 square feet (ft) of protected riparian buffers for the purpose of constructing the access road and 25 feet of stream and 1,871 ft2 of protected riparian buffers for the purpose of installing the sewer line, as described within your application dated May 12, 2003. After reviewing your application, we have decided that the impacts are covered by-the N.C. Division of Water Quality (DWQ) General Water Quality Certification Number(s) 3374 and 3404 (GC3374 & 3404). The Certification(s) allows you to use Nationwide Permit(s) 12 and 14 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0233. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control and Non-discharge. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us anew application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Conditions: 1. Water Quality Certification(s) The proposed project must comply with all of the conditions of General Water Quality Certification(s) (GC) 3374 and 3404. 2. Diffuse Flow An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B .0233(5). 3. Written Stormwater Management Plan (No Further Approval Needed) The final, written stormwater management plans provided attached to your application, must be implemented and the stormwater management facilities shall be constructed and operational before any permanent building is occupied at the subject site. The structural stormwater practices as approved by this Office as well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA permit. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 150B. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and the Neuse riparian buffer protection rule as described within 15A NCAC 2B .0233. A Pre-construction Notification Application (PCN) is attached, which includes an agent authorization form. The proposed project consists of impacts from the construction of an access road for a new SPCA facility and a sewer line. The project is located south of the intersection of Tryon Road (SR 1370) and Withers Road (SR 1466) and is bordered on the west by Norfolk Southern Railroad. The site is approximately 44 acres in size and consists primarily of wooded land. Please refer to the attached USGS map, which displays the location of the proposed project. S&EC performed a detailed wetland delineation and buffer evaluation on the property in April of 2000. Mr. Charles Brown of the NC-DWQ conducted a site visit on May 11, 2001 to confirm the buffer determination. A copy of Mr. Brown's letter is attached. The applicant requested a detailed wetland delineation and buffer evaluation on the property prior to site plan development in order to avoid jurisdictional wetlands and waters and riparian buffers to the maximum extent practicable. These impacts are elaborated upon within the attached PCN form and are shown on the attached inset impact maps. The proposed roadway, Pet Finder Lane, is needed to gain access to the proposed SPCA facility from the existing Withers Road. Because of the location of the existing out parcels and the intermittent channel that flows adjacent to Withers Road, impacts are unavoidable in order to access the southern portion of the property. Please also note that the proposed sewerline must connect to an existing line to the south of the property and must cross a perennial channel that flows east-west near the southern property line. Both crossings are at a near perpendicular angle and following construction of the sewerline, all original contours will be restored. The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and compensatory mitigation to offset unavoidable losses of waters of the US. The proposed road and sewerline are necessary to access the southern portion of the property and provide sanitary service to the proposed facility, as discussed above. Because the applicant has minimized impacts to the maximum extent practicable S&EC believes further compensatory mitigation should not be required by the USACE. NC-DWQ's current policy requires written concurrence for stream impacts to stream channels within the Neuse River Basin. We request written concurrence that the project complies with the 401 Water Quality Certification associated with Nationwide Permit 12 and 14. NC-DWQ's current policy does not require wetland or stream mitigation for perennial stream channel impacts below 1 acre and 150 linear feet per project. Because the total impacts consist of 85 linear feet to an intermittent channel, 25 linear feet of temporary impacts to a perennial channel, and no wetland impacts are proposed, we do not believe that wetland nor stream mitigation should be required by NC-DWQ. Please note that following construction the site will contain 31% impervious surface, as per the project engineer. Please see the attached stormwater plan, provided by John A. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. The proposed roadway Pet Finder Lane is needed to gain access to the proposed SPCA facility from the existing Withers Road. Because of the location of the existing out parcels and the intermittent channel that flows adjacent to Withers Road impacts are unavoidable in order to access the southern portion of the property. Please also note that the proposed sewerline must connect to an existing line to the south of the property and must cross a perennial channel that flows east-west near the southern property line. Both crossings are at a near perpendicular angle and following; construction of the sewerline all original contours will be restored. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete.
