Please reference the application of the NC Seafood Industrial Park Authority for Department
of the Army (DA) authorization and a State Water Quality Certification to construct a 28-slip
marina, on property located at Lot 13 of the NC Seafood Park, off State Road 1140, adjacent to
Broad Creek and the Roanoke Sound, in Wanchese, Dare County, North Carolina. Your receipt
of this letter verifies your acceptance of a valid request for certification in accordance with
Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section 404 of the Clean
Water Act, and we have determined that a water quality certification is required under the
provisions of Section 401 of the same law. A Department of the Army permit will not be granted
until the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days after receipt of
a request for certification is a reasonable time for State action. Therefore, if you have not
acted on the request, or asked for an extension of time, by June 9, 2003, the District
Engineer will deem that waiver has occurred.

On July 24, 2000, we renewed General Permit No. 198000291 (copy enclosed), which
provides Federal authorization for construction activities that receive authorization from the State
of North Carolina.
A review of your application received April 3, 2003, for Department of the Army (DA)
authorization to construct a 28-slip marina, on property located at Lot 13 of the NC Seafood
Industrial Park, off State Road 1140, adjacent to Broad Creek and the Roanoke Sound, in
Wanchese, Dare County, North Carolina, indicates it to be a candidate for Federal authorization
under this general permit. Accordingly, the administrative processing of your application will be
accomplished by the North Carolina Division of Coastal Management. Comments from Federal
review agencies will be furnished to the State.
If your application must be withdrawn from this general permit process for any reason, you
will be informed regarding its further management. If there are no unresolved differences in
State-Federal positions or policies, the final action taken on your application by the State will
result in your receiving written notice from us that your application is consistent with the general
permit and you may commence your activity. Only after receiving such confirmation should you
begin work.

APPROVAL of 401 Water Quality Certification (GC3351) with ADDITIONAL CONDITIONS
To Whom It May Concern:
You have our approval, in accordance with the attached conditions, to fill 0.014 acres of waters at the subject property as
described in your application received by the Division of Water Quality (DWQ) Wetlands/401 Unit on April 4, 2003. The
approved impacts are associated with the construction of a 28 slip marina with a boat ramp, parking area and wave
attenuator. After reviewing your application, we have determined that the wetland impacts are covered by the Division of
Water Quality (DWQ) General Water Quality Certification Number 3351 (GC3351). This Certification allows you to
Regional General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you
should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project
including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval will expire when the
accompanying 404 permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be
given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total
fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation
may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification and any additional conditions listed below.
Conditions:
1. EPA/SPCC Plans
The project must adhere to all EPA/SPCC Plans for fuel storage and dispensing.
2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any
subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands
Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
3. Water Quality Certification(s)
The proposed project must comply with all of the conditions of General Water Quality Certification(s) (GC) 3351.
Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or
civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the

Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or
CAMA permit.
If you do not accept any of the conditions of this Certification (associated with the approved water impacts), you may ask
for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and
binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

Bob,
I have reviewed the Baily Creek Marina Plans, and although I don'tpersonally approve of the project or
of its upstream (windward) location adjacent to a large USACE constructed wetlands or the fact that its
in SA waters, or that there is a PNA upstream 150', or that its a hybrid of another project we rejected 2
years ago, or that its in open for shellfishing waters,...aside from all that, I recommend Issue
w/conditions that they adhere to all EPA/SPCC Plans for fuel storage and dispensing.
As for other business, did you receive the request for an buffer call appeal forwarded to you from me,
from a Bud Brooks? If so do you have a time when you might be able to take a look at it?

Cyndi,
The State Clearinghouse provided a letter confirming that no further
environmental review is required for the Bailey Marina EA/FONSI. In
response to John Dorney's letter dated 4/8/03 for this project
(DWQ#03-0396), the CAMA Major permit application was off hold effective
5/8/03. I am requesting that DWQ re-activate this project.

Project Setting
The applicant, the North Carolina Seafood Industrial Park Authority, owns and operates
a commercial industrial park located on 54 acres at the end of Harbor Road (SR 1140),
Wanchese, Roanoke Island, Dare County. The park has an extensive shoreline that fronts a
manmade basin off Mill Landing Creek, Roanoke Sound and Broad Creek. The park was
created by filling an existing salt water marsh with spoil material derived from dredging the
basin. The property is divided into lots that vary in size and are leased to tenants. Lot 13 is
approximately 1.02 acres in size and is located on the northeast side of Harbor Road and
adjacent to Broad Creek. It has an elevation of approximately 6 ft. above normal water level
and has sandy soils. The lot is vegetated mostly with yard grasses.
The shoreline of Lot 13 has a coastal wetland fringe that varies in width from 0 to
approximately 30 ft. wide and is vegetated with Spartina alterniflora along the waterline and
Juncus roemerianus and Typha latifolia toward the upland area. Approximately 30 ft. of the
shoreline is void of wetlands. Above the coastal wetland fringe, at an elevation of
approximately 2 ft. above normal water level (NWL) is a 404 wetland fringe vegetated with
common reed and grasses. Manmade features on the property include a 60' x 80' metal
building and a septic drain field.
Adjacent property consists of lots of varying sizes and similar characteristics. The lot to
the east is vacant and the lot to the west is also vacant and was permitted for a 28 slip small
boat marina.
The waters of Broad Creek are classified as SA by the Division of Environmental
Management and are open to shellfishing. The area of Broad Creek upstream from the
proposed development site is classified as a Primary Nursery Area by the Division of Marine
Fisheries. The water depth in the vicinity of the project range from 3'-5 1/2'.
The development proposal is for a 28 boat slip marina for open boats 24 feet or less in
length with no heads and no cabins. A boatramp for launching and recovery of boats and a
fuel dock is proposed for the marina infrastructure and a 241 ft. long floating wave attenuator
is proposed to protect the moorings.
The proposed upland development of the property consists of a 120' x 140' gravel
parking area and a 20,000 gallon fuel storage facility for retail sales.

The marina development over water includes the construction of an 8', wide 20' long
mooring pier with 28 slips, 14 on each side. The slips are approximately 28' long and 12'
wide and 14 finger piers 12' long and 3' wide and 42 free standing mooring pilings. An 8'
wide 102' long elevated boardwalk will connect the mooring pier to the gravel parking area.
A 20' wide concrete pad boatramp is proposed to be located at the northwest corner of
the lot. The ramp will extend approximately 30' into Broad Creek. A 6' wide 60' long
launching pier is proposed on the north side of the ramp and an 8' wide 100' long launching
pier and fuel dock is proposed for the south side of the ramp.
The proposed wave attenuator will be located approximately 310' from shore and will
have a 50' return on the north end and will have a total length of 291'.
Anticipated Impacts
The proposed project will shade approximately 4,122 sq. ft. of Public Trust Area,
Estuarine Waters Areas of Environmental Concern (AECs); 200 sq. ft. of Coastal Wetlands
and Estuarine Shoreline AECs; 160 sq. ft. of 404 wetlands within the Estuarine Shoreline;
and, 350 sq. ft. of upland within the Estuarine Shoreline AEC.
The boatramp will result in 600 sq. ft. of Public Trust Area, Estuarine Waters AECs
being filled and 1200 sq. ft. of Estuarine Shoreline being covered with impervious surface.
The proposed gravel parking area will result in approximately 16,800 sq. ft. of upland grassy
area being filled with gravel. Approximately. 2,400 sq. ft. of the area is located in the
Estuarine Shoreline AEC. The total water area captured by the marina and breakwater will be
72,000 sq. ft. The fuel storage facility is located upland from any AECs; however, supply
lines will have to be buried between the tank and the fuel dock.
Temporary water turbidity will occur during construction. The project will result in
more boating activities and access in the area.

The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development of property located at Lot 13 at the end of Harbor Road (SR
1140) in Wanchese, Dare County. Because your project is subject to review under the North
Carolina State Environmental Policy Act (NCSEPA, G.S. 113A-1), your application can not be
considered complete until the appropriate environmental document has successfully complete the
NCEPA review process.
During the time the NCSEPA review is occurring, we will circulate your permit application to
state and federal review agencies for comment. However, the statutory time period that is
required for considering CAMA permits will not be running. You will also be responsible for
making and incorporating any NCEPA project changes to the CAMA permit application. Once
the environmental review process is completed and a Record of Decision issued, a letter will be
submitted to you stating that the application is now deemed complete and the project deadline for
making a permit decision is 75 days from the day of NCEPA completeness. If you are not
notified of a final action by the initial deadline, you should consider the review period extended.
Under those circumstances, this letter will serve as your notice of an extended review. However,
an additional letter will be provided on or about the 75`h day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you fill find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property, or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.

Impact (FONSI) or Record of Decision (ROD) from the State Clearinghouse in accordance with NCAC 15A:01C.0402. We have
received a field investigation report from the Division of Coastal Management (DCM) which notes that the CAMA Permit will also
remain on hold pending completion of the SEPA process. We recommend that you notify DCM and us when' the SEPA process is
complete so we can re-activate the project.
