Box 250 Hatteras, VA, 27943 APPROVAL of 401 Water Quality Certification with Additional Condition Dear Mr. Dorman: You have our approval, in accordance with the attached conditions, to shade 0.02 acre of estuarine and Public Trust Water in order to re-configure six existing boat slips to create a total of ten boat slips within an existing boat basin in the Village of Hatteras in Dare County, as described in your application received by the Division of Water Quality on January 15, 2003. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded from our web site at hftp://h2o.enr.state.nc.us/ncwetlands. This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed and U.S. Coast Guard regulations. PROJECT SUMMARY: This project is located within an existing boat basin at the end of Pricilla Curve Road, in the Village of Hatteras. This proposal involves the re-configuration of 6-existing boat slips to create a total of 10-slips. Paley-Midgett Partnership, LLC, Pricilla Curve Road, Hatteras Village, Dare County FIELD INVESTIGATION REPORT Page 2 Project Setting The application site is located within an existing boat basin at the end of Pricilla Curve Road (SR 1253), 0.15-mi. from SR 1237, Kohler Drive, in the Village of Hatteras. The basin is along Back Creek in Dare County. The site consists of a 0.95-acre lot that is situated between the end of Pricilla Curve Road and Back Creek. This waterbody is also referred to, locally, as Muddy Creek. This creek flows through the north part of Hatteras village and connects to the Pamlico Sound both through Hatteras Harbor and Sandy Bay, which is located on the east side of Hatteras village. According to the North Carolina General Warranty Deed provided with this permit application, this parcel is presently owned by the Paley-Midgett General Partnership, and was recorded by the Dare County Register of Deeds on June 3, 1988. According to the application, this site is approximately 4.8-ft above the normal high water level (NHWL). Approximately one-half of the applicant's property is vegetated in coastal and freshwater wetland plant species. The existing upland site was probably created from dredge spoil previously excavated from the basin area. The site currently includes a multi-floor wood frame house, the 6-slip basin, as well as a temporary dredge spoil structure that remains from more recent maintenance dredging. This lot has approximately 180-1f of shoreline that is situated entirely along the basin. This basin includes 170-ft of boardwalk and bulkhead, with 3 piers that extend from the boardwalk into the basin area. These piers extend partially in front of the western side of the `Dempsey' shoreline portion of the basin. They range between 20 and 50-ft in length, and each pier is 6-ft wide. The existing 20-ft long pier may possibly extend into or across the adjacent riparian access to the east. The shoreline of the basin is shared by an adjacent riparian property to the east, owned by Larry H. Dempsey, Jr. The adjacent riparian property to the west is owned by Dale Burrus. The shorelines of these adjacent properties are not developed, and are not stabilized with any hardened structures or bulkheads. These shorelines are vegetated with coastal wetland marsh. Most of the shoreline on the Paley-Midgett General Partnership tract has been filled, and is stabilized with a wooden bulkhead, as referenced above. At the request of the applicant's agent, the Division of Coastal Management conducted a delineation of Coastal Wetland AEC jurisdiction on August 13, 2002. A 10-ft to 30-ft wide coastal wetland marsh fringe extends from the east side of the basin shoreline and upland area, and extends south and west, around the developed part of the tract, to Pricilla Curve Road. This marsh area is vegetated in Spartina alterniflora, Juncus roemerianus, Distichlis spicata, Spartina patens, Scirpus spp., Borrichia frutescens, Iva frutescens, Myrica cerifera, and Baccharis halimifolia. The application does not address the occurrence of any erosion along the basin area shoreline, but does reference that areas beside the existing 20-ft long pier of the eastern-most portion of the basin, have shoaled in, and this area is no longer used as a boat slip area. Paley-Midgett Partnership, LLC, Pricilla Curve Road, Hatteras Village, Dare County FIELD INVESTIGATION REPORT Page 3 Back Creek appears to have been channelized, and serves as a protected channel connection between the Hatteras Village harbor basin and the northern entrance to the Pamlico Sound. This creek is buffered from the Pamlico Sound by a several hundred-foot wide coastal wetland island with the Rollinson Channel to the west, Durant's Point to the north, and Sandy Bay to the east. The creek at the Paley-Midgett basin (including the basin width) is over 250-ft wide, and has water depths that range between 2.5-ft and 5.5-ft below the water surface (NHWL). The application platwork indicates that the water depths, 65-ft offshore are about 5-ft. The harbor bottom consists predominately of sand, muck and debris, and during the application site visit, there were no visible areas of submerged aquatic vegetation. During this visit, no shellfish were observed along the water bottom. Juvenile finfish and some crustaceans were observed within the waters and wetlands along the shoreline. The waters of this creek carry the same water classification as the Pamlico Sound. The North Carolina Environmental Management Commission has designated these waters as `SA' waters (suitable for shellfish propagation and harvesting); however, the waters in this vicinity are closed to the commercial harvest of shellfish. The North Carolina Marine Fisheries and Wildlife Resources Commissions classify the waters of the Pamlico Sound as Coastal Waters. The Coastal Resources Commission (CRC) has also designated these waters as Estuarine Waters and Public Trust Areas of Environmental Concern (AEC). Also under the designation of the CRC, an Estuarine Shoreline AEC extends in a contour of 75-ft landward of the NWL/NHWL. Coastal wetland vegetated areas, like the one described above, have also been designated as Coastal Wetland AEC by the CRC. Previous permits for work on this property include the issuance of CAMA Minor permit (permit # 2002-161) for site development within the Estuarine Shoreline of the Pamlico Sound, and CAMA General Permit # 32428-A for maintenance dredging excavation of the existing basin and slip areas. This basin maintenance was conducted and completed in November 2002, and this general permit will expire on January 14, 2003. The Minor Permit was issued for site work, including the replacement of an existing single-family dwelling. This permit will expire on December 31, 2005. Project Description This proposal involves the re-configuration of 6-existing boat slips, and the creation of 4- additional slips. This will be accomplished by extending one of the existing piers, and constructing 60-ft of additional pier with 40-ft of `L'-head dockage to create the 4-additional boat slips. The 20-ft long pier will be extended an additional 30-ft. The extension will be within the same alignment as the existing pier. The footprint of the two remaining piers will remain un-changed. Paley-A idgett Partnership, LLC, Pricilla Curve Road, Hatteras Village, Dare County FIELD INVESTIGATION REPORT Page 4 A fourth pier will be built at the east side of the boardwalk, and will be 60-ft in length with a right-angle `L' toward the east. This `L' section will be 40-ft in length. All portions of this new pier will be 6-ft in width, and extend a total distance of 72-ft into the basin. Work will also include the repair or replacement of the existing boardwalk within the existing structure footprint. Anticipated Impacts This project does not propose any development for non-water dependent uses. This project does not propose any structures that will result in the filling or shading any coastal wetlands. The principle anticipated impacts from this project are associated with shading of an additional 780-sf of Public Trust Area waters (and Estuarine Waters), the potential restriction of some neighboring riparian access, and the possible Public Trust encroachment beyond the one-fourth water body width. The existing 20-ft pier appears to extend into the adjacent riparian setback to the west side of the basin. Previously, a slip existed on both sides of this pier. In more recent times, the slip on the west side of this pier has been abandoned due to shallow water depths, and shoaling on this side. The extension of this pier will encroach into the `Dempsey' riparian area. According to the application package, certified mail/guaranteed receipt notification was received by a `Larry Dempsey'. He has responded with a statement of `no objection' to the project. Although, this area in question may not have sufficient water depths to provide or sustain any riparian use, the extension of this 20-ft pier an additional 30-ft will create some additional interference with the adjacent neighbor's riparian access. According to the submitted application platwork, the portion of Back Creek affected by this proposal is approximately 265-ft in width. The proposed additional pier will extend 72-ft waterward of the NHWL. This proposed pier will result in a structure extending 6-ft beyond the one-fourth water body width creek. There are no current adjacent, or opposite bank riparian uses. These shoreline areas are vegetated with what can be described as significant coastal wetland marsh fringes, and therefore, have a diminished potential to have public trust development along these shoreline areas that would extend waterward of the NHWL. None-the-less, the proposed pier alignment will result in a structure beyond the one-fourth water body width distance, and would be inconsistent with this guideline in our use standards. An inspection of mapping data on cultural resources revealed that archaeological or cultural resource findings in the vicinity of this project have been recorded on the available maps. It is important to note that Hatteras Island has a rich heritage in cultural resources, and these maps have not been updated in at least 10 years. Submitted by: Dennis W. The property is located at the end of Pricilla Curve Road adjacent to Back Creek in Hatteras, Dare County, North Carolina. The subject property currently has a bulkheaded shoreline and 170 linear feet of dock that run adjacent to this buklkhead. In addition there are 6 boat slips and, three separate piers that extend out perpendicular from the shoreline. A CAMA General Pemiit (#32428A) was recently issued for maintenance dredging within the vicinity of the boat slips. The permitted dredge area will provide adequate water depth for the proposed slip configuration, therefore no additional dredging is being proposed. The project proposes to reconfigure the existing boat slips and provide 4 additional slips which will bring the total to 10. The boat lift and slip located on the western end of the dock is to be removed because of continued shoaling in this portion of the basin, therefore this slip will be used in another location. A 6' wide x 30' long pier extension will also be added to the existing 6' wide x 20' long pier that currently exists on the western end of the dock. The remaining slips will be unchanged and an additional 6' wide x 60' long pier with a tee head 6' wide x 40' long is to be constructed on the eastern end of the existing dock. This proposed pier addition will provide dock space for the 4 additional boat slips. The enclosed site plan and details accurately depict the proposed construction as well as the location of the existing dock and boat slips being proposed.
