We are in the process of negotiating with the City of Greensboro over certain specifics relating to street access, future subdivision of the property, and extension of utilities to the site. You have asked for additional information relating to the engineering design of the road crossing. We are not in a position to provide this information at this time since the final design of the road will depend on the location of access points allowed by the City of Greensboro. Lowell Easter Property, Lot 1 DWQ Project # 02 0940 Guilford County Dear Mr. Easter: The Division of Water Quality has reviewed your plans for the discharge of fill material into approximately 130 linear feet of an Unnamed Tributary to Deep River, Cape Fear River Basin, Class WS-IV waters, Guilford County for the purpose of constructing a road crossing. Insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H.0506. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H.0507(e) and will place this project on hold as incomplete until we receive this additional information. (1) Please provide us with information supporting your position that states your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Documentation such as maps, narratives, economic analyses, that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification request. (2) Please provide documentation detailing your position that the project has been designed such that adverse impacts to surface waters have been minimized and existing uses have been protected to the best of your ability. (3) Additional information regarding the road crossings is also necessary for our review. Please submit detailed plans for each crossing. The details (both plan view and profile) must include culvert size and length, headwalls, endwalls, and rip-rap and the linear footage of stream impact associated with each. In addition, 02 0940 Page 2 please provide this office with evidence that the design and placement of the culverts and associated structures will be conducted in such a manner that they will not result in a dis-equilibrium of the stream bed and banks, adjacent to and upstream and downstream of the crossings. The placement of the culverts must be placed below the elevation of the streambed to allow low flow passage of water and aquatic life. (4) Your project is located within the Randleman Lake Water Supply Watershed and the City of Greensboro has been mandated by the Environmental Management Commission to develop or modify an ordinance that addresses the protection and maintenance of riparian areas as well as stormwater management. Please submit documentation that you project is in compliance with the City of Greensboro. (5) Please submit detailed plans showing the entire proposed development with respect to all protected riparian areas, Zone 1 and Zone 2, streams and wetlands. Show the extent of all fill slopes and any proposed re-vegetation plans for any disturbance of Zone 2. (6) Even though road crossings are an allowable activity within the Randleman Lake Water Supply Watershed, you must demonstrate, as stated in 15A NCAC 02B .0250 (2)(e), that the project shall be (or will be) located, designed, constructed and maintained to have minimal disturbance, provide maximum nutrient removal and erosion protection, have the least adverse effects on aquatic life and habitat, and protect water quality to the maximum extent practical through the use of best management practices. Please address these issues in your response. (7) Please provide documentation regarding the management of the stormwater from this project. Please keep in mind that diffuse flow must be provided through the buffer zones and temporary sediment and erosion control measures cannot be located within Zone 1. (8) Division approval of your on-site stormwater management may be required as a condition of the 401 WQ Certification. In addition, due to the fact that the project is located in WS waters, an extended detention wetland may be required. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. For administrative and distribution purposes, the USACE requires information to be submitted on sheets no larger than 11 by 17-inch format; however, DWQ may accept paperwork of any size. DWQ prefers full-size construction drawings rather than a sequential sheet version of the full-size plans. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the.project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The road crossing, as shown on the attached plans, was located to reduce the number of curb cuts onto Burnt- Poplar 'and Gallimore Dairy Roads. The location proposed allows access to lot 1 and adjoining properties for future subdivision, while reducing the amount of stream impacted by crossing near its upstream end.. Other locations considered do not meet both of these criteria with single access points. Page 7 of 12 VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type, of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required'for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft. Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.htrnl. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. Applicants will be notified early in the review process by the 401/Wetlands Unit if payment into the NCWRP is available as an option.
